Mayer moved that Council approve Resolution No. 74, Series 1995, Dave Neilsen, Ltd., Final PUD <br />Development Plan. Seconded by Keany. <br /> <br />Lathrop offered a friendly amendment that the rooftop HVAC enclosure not exceed a maximum of <br />5' in height above the roof line. <br /> <br />Mayer and seconder, Keany, accepted, that. Roll call was taken. Motion passed by a vote of 5 - 1 <br />with Howard voting against and Levihn being absent. <br /> <br />RESOLUTION NO. 75, SERIES 1995 - APPROVING SPECIAL REVIEW USE FOR THE <br />INTERNATIONAL MARTIAL ARTS ASSOCIATION AND CONTINUED USE AS A <br />CHURCH FACILITY <br /> <br />Paul Wood, Planning Director, stated that the proposed use is a church facility on Sundays and the <br />International Martial Arts Association evenings and Saturdays. The 46 off-street parking spaces <br />included two handicapped spaces. Planning Commission approved the use on December 12, 1995, <br />with five conditions which were included on Resolution. No. 75. <br /> <br />Davidson called for the applicant's presentation. <br /> <br />Mark Van Ark, 1 Continental View Drive, Boulder, Colorado, with ReMax Commercial representing <br />the current owner of the facility, Trinity Evangelical Free Church stated that he had submitted the <br />special review use on behalf of Mr. Madani. He explained that there would not be a high parking use <br />as students are usually dropped off and picked up. <br /> <br />Keany was concerned about the location of the Burlington Northern property line and exterior <br />lighting. He wanted the parking lot repainted. He did not want "No Parking" signs on Main or <br />Griffith as it would impact neighbors. <br /> <br />Howard stated for the record that his wife, daughter, and oldest son attend this martial arts school. <br />He felt the internal lit sign fit with the neighborhood. <br /> <br />Sisk did not want a variety of signs for different businesses on the property, if they rented out office <br />space. He preferred a master sign. <br /> <br />Mayer stated that his daughter used to be a student of the International Martial Arts School. He <br />wanted the total signage on site limited and turned offby 10:00 p.m. <br /> <br />Davidson felt there should not be "No Parking" signs on Main or Griffith. <br /> <br />Howard moved that Council approve Resolution No. 75, Series 1995, International Martial Arts <br />Association Special Review Use with conditions No. 2, 3, and 5, and the allowance of the existing <br />2'x 10' sign being transferred over.
