Section 2. The introductory sentence of Subsections 13.32.060.B, and Subsections <br />13.32.130.A, 13.32.130.0 and 13.32.150.A of Chapter 13.32 of the Louisville Municipal Code <br />are hereby amended to read as follows (words to be deleted are stricken; words to be <br />added are underlined): <br />§13.32.060. Wastewater Discharge Permit Requirement. <br />B. At the discretion of the super-intendent control authority, the superintendent <br />control authority may use general control mechanisms to control discharges to the <br />POTW if the following conditions are met. All of the facilities to be covered <br />must: <br />§ 13.32.130 Enforcement. <br />A. Administrative fines and/or orders. Notwithstanding any other section of <br />this title 13 of this Code, any industrial user who is found to have violated any <br />provision of this chapter, or of any permits and orders issued hereunder, and who <br />has been served a notification of violation, shall be subject to an administrative <br />penalty in an amount not to exceed $1,000.00 per violation. Each day on which <br />noncompliance shall occur or continue shall be deemed a separate and distinct <br />violation. Such assessments may be added to the user's next scheduled sewer <br />service charge and the public works department shall have such other collection <br />remedies as they have to collect other service charges. Unpaid charges, fines and <br />penalties shall constitute a lien against the individual user's property. Any <br />industrial user which disputes such administrative penalty must file, within ten <br />days of being notified of the penalty, a request with the public works director for <br />reconsideration of the penalty. The public works director shall schedule and hold <br />a hearing on the matter within 15 days of receiving the request from the industrial <br />user. <br />C. Consent orders. The director of public works is hereby empowered to enter <br />into consent orders, assurances of voluntary compliance, or other similar <br />documents establishing an agreement with the industrial user responsible for the <br />noncompliance. Such orders will include specific action to be taken by the <br />industrial user to correct the noncompliance within a time period also specified by <br />the order. Consent orders shall have the same force and effect as compliance <br />administfative orders issued pursuant to subsection D E of this section. <br />§13.32.150 Penalties and Remedies. <br />A. Civil penalties. Any industrial user who has violated or continues to violate <br />this or any order or permit issued under this chapter, shall be liable to the City <br />for a civil penalty of not more than $1,000.00 per day per <br />Ordinance No. 1700, Series 2015 <br />Page 2 of 6 <br />
