violation for as long as the violation continues. In addition to the above described <br />penalty and damages, the director of public works may recover on behalf of the <br />City reasonable attorney's fees, court costs, and other expenses associated with the <br />enforcement activities, including sampling and monitoring expenses. The director <br />of public works is authorized on behalf of the City to shall petition the municipal <br />or district court to impose, assess, and recover such sums. In determining the <br />amount of liability, the court shall may take into account all relevant <br />circumstances, including, but not limited to, the extent of harm caused by the <br />violation, the magnitude and duration, any economic benefit gained through the <br />industrial user's violation, corrective actions by the industrial user, the compliance <br />history of the user, and any other factor as justice requires. <br />Section 3. Subsection 13.32.060.C.2, Subsections 13.32.060.D.1 and D.2, and <br />Subsection 13.32.060.D.4.(i).ii of the Louisville Municipal Code are hereby amended to read as <br />follows (words to be deleted are strieken- through; words to be added are underlined): <br />§13.32.060. Wastewater Discharge Permit Requirement. <br />C. Both individual and general control mechanisms must be enforceable <br />and contain, at a minimum, the following conditions: <br />1. Statement of duration; <br />2. Statement of nontransferability <br />aerator pursuant to subsection J of this section; <br />D. Permit application required. <br />1. Existing industrial users holding permits. All industrial users <br />that have an existing permit issued by the city and who wish to continue <br />such discharges in the future, shall, within 90 days prior to expiration of <br />the permit, reapply to the city for a wastewater discharge permit in <br />accordance with subsections A74 D.4 of this section. <br />2. New industrial users. All new significant industrial users and <br />non - significant categorical industrial users (as defined in <br />section 13.32.020) who proposes to begin or recommence discharging into <br />the POTW shall, at least 90 days prior to the date upon which any <br />discharge will begin or recommence, apply to the city for a wastewater <br />discharge permit in accordance with subsections A74 D.4 of this section. <br />[D.4(i)]ii. No increment referred to in subsection A.4.(i)i D.4.(i)i. <br />of this section shall exceed six months. <br />Section 4. Subsections 13.32.120.A and 13.32.120.B.2 of the Louisville Municipal <br />Code are hereby amended to delete from the tables therein, respectively, the Daily Maximum <br />Ordinance No. 1700, Series 2015 <br />Page 3 of 6 <br />
