land hiding behind a commercial area clearly does not have the same
qualities that the current open space does.

Davidson called for anyone else who wished to speak on this
subject.

NO};E

Davidson closed the Public Hearing and asked for Council comments.

Howard:

There was an allegation that the
City of Louisville has approximately
$4 million for the purchase of
property.

Brand:

This is in our Budget for 1993.
There is approximately $4 million
for the development of parks, ball
field, and the purchase of some park
land. It's in our CIP.

Howard:

Is it possible for us to purchase
the land without a vote of the
people, since we got into the
agreement from a vote of the people?

Tami Tanoue, acting City Attorney, stated that there isn't any
statute which requires a vote of the people in order to acquire
property. She didn't know why this agreement would require that.

Howard:

What would be the effect of the City
of Louisville purchasing this
property outright for whatever
purpose?

Brand:

If it were possible to do that, I
think I would want to introduce it
in that manner. If you purchase the
property under the current
agreement, it would be for open
space.

Ho%~ard:

So, what you're saying is as long as
the agreement is in force (about 12
years) ....

Tanoue:

My understanding that the agreement
did have a 15 year term.

Howard:

Ever since I've gotten on Council
I've heard discussions on the
legality of the various entities,

13
