We did not have any kind <br />of record. In a discussion with Mr. <br />McKee of the Army Corps of <br />Engineers, he indicated that he did <br />not have any recollection. He took <br />over this territory in 1985. He did <br />indicate that the Corps began the <br />regulation of that fill activity <br />about 1977. Prior to about his <br />arrival, there was really a sporadic <br />effort, on the part of the Corps, to <br />regulate fill activity on any <br />property. They just didn't have the <br />staff. <br /> <br />Mayer: <br /> <br />Was it a legal fill? If it's not, <br />is there still a legal implication <br />from that that carries over to <br />today? <br /> <br />Brand: <br /> <br />I don't think there is any way to <br />determine what might have happened <br />in 1985, if someone did fill, and <br />whether it was legal or not, because <br />there are no records to tell us what <br />happened. <br /> <br />Tom Phare, Public Works Director, stated that disturbed wetlands <br />are typically, or can be, mitigated off site.
