PROPERTY THROUGH CONDEMNATION - 2ND READING - PUBLIC HEARING (PUBL. <br />LSVL. TIMES 5/5/93) <br /> <br />Griffiths read by title only Ordinance No. 1104, Series 1993, "An <br />ordinance of the City Council of the City of Louisville authorizing <br />acquisition of certain property required for open space, park, or <br />recreational purposes for the benefit, health, safety, and welfare <br />of the citizens of Louisville and designating an agent on behalf of <br />the City to engage in good faith negotiations to acquire said <br />property, and upon failure to secure a negotiated acquisition, <br />authorizing the City Attorney or the City Attorney's designee to <br />proceed to acquire said property through condemnation." <br /> <br />Davidson opened the Public Hearing calling for anyone in the <br />audience who wished to speak in favor or against Ordinance No. <br />1104. <br /> <br />NONE <br /> <br />Davidson closed the Public Hearing. <br /> <br />Davidson called for Council comments. <br /> <br />Lathrop expressed his great displeasure with this ordinance. He <br />had read the ordinance and the rationale for acquiring Mrs. <br />Allenbaugh's property under condemnation. He again walked the <br />property to try to justify the rational expressed to justify doing <br />this. He stated that in no way can he come to any sort of <br />resolution within himself that this is even remotely a good cause <br />for a condemnation proceeding. He commented that in light of <br />Council's discussion of a week ago about the extension of the bike <br />trail from the general area of the Allenbaugh property to connect <br />into Cleo Mudrock Park, somehow the Council failed to see the <br />danger of crossing Hoover Avenue. He kept that in mind, as he <br />stood on the bike trail and looked at this property and where the <br />easement to Mrs. Allenbaugh's property crosses the bike trail and <br />all of the various factors that have been expressed. He wanted <br />everyone to know that what Council is doing, to him, is what is <br />wrong with government. He refused to support it. <br /> <br />Hedding stated that he opposed this when it was first brought <br />before Council and he still does. He had explored the property and <br />there is adequate passage, as it exists, with the Allenbaugh <br />property in tact to have a bicycle path, to have access to the <br />bicycle path from the neighborhood in the future, without using <br />Allenbaugh's driveway. He stated that condemnation is the most <br />serious and grave kind of legislative or governmental action that <br />he could perceive of. He couldn't believe Council will be doing <br />this. He felt that it was an extraordinary abuse of power. <br /> <br />Mayer stated that this lot was a mistake and was one of the poorest <br />examples of residential planning that he had seen.
