APPROVAL OF MINUTES <br />APPROVAL OF BILLS <br />APPROVE CHANGE ORDER - RECREATION TENNIS COURTS <br />APPROVE CHANGE ORDER - LOUISVIT.LR PARK PLAYGROUNDS <br />APPROVE ADDENDUM NO. 2 - AMERICAN RED CROSS STATEMENT OF AGREEMENT <br />APPROVE BID - NORTHWEST PARK HARD SURFACING <br />AWARD BID - NORTHWEST PARK OVERLOT GRADING AND STORM DRAINAGE <br /> PROJECT <br />AWARD BID - 1993 CHIP SEAL PROJECT <br /> <br />PUBLIC COMMENTS - ON ITEMS NOT ON THE AGENDA <br /> <br />Davidson called for anyone wishing to speak on any item not on the <br />Agenda. <br /> <br />NONE <br /> <br />REGULAR BUSINESS <br /> <br />APPOINTMENT - PLANNING COMMISSION VACANCY - COMPLETING 4 YEAR TERM <br />(EXPIRES 1/96) <br /> <br />Davidson appointed Sarah Klahn to fill the vacancy on the Planning <br />Commission. <br /> <br />DISCUSSION/DIRECTION -REQUEST FOR RIGHT-OF-WAY ENCROACHMENT DAHLIA <br />STREET <br /> <br />Scott Osgood, 838 West Dahlia Court, Louisville, Colorado, stated <br />that last year Dr. Susan Stein came before Council seeking a <br />variance on a fence she had constructed approximately 2 ft. back <br />from the sidewalk on Dahlia Street. The request was denied. He <br />stated it's back again, but the circumstances are a little <br />different. He stated that he was building a fence about the same <br />time Stein was. When the issue came up about Stein, he was asked <br />by the enforcement officer to hold off building his fence, which is <br />why he has had just fence posts up for about a year. Osgood's <br />fence posts were installed on 5 ft. centers back from the sidewalk. <br />He had a survey at the time that showed his property line to be up <br />to within 2 ft. of the sidewalk, so he thought he was well within <br />his boundary lines. He had a contractor doing it and there was a <br />building permit obtained. He stated that the fence posts are 5 ft. <br />back from the sidewalk and if the street were centered in the <br />right-of-way, would probably be about on the right-of-way line. As <br />it happened, the street was not exactly in the center of the right- <br />of-way. The street, from sidewalk across the pavement to the other <br />sidewalk, is about 60 ft. in width now. The right-of-way on that <br />street from Fireside Elementary School going north and east is 60 <br />ft. wide. The newer right-of-way going from Fireside Elementary <br />School back to Pine Street is 70 ft. in width. What Osgood and <br />four of his neighbors are requesting is the right to put their <br />fences in that space approximately 4 1/2 ft. back from the sidewalk <br /> <br /> <br />
