Griffiths: Not at this time. Howard felt it was important to have it in the agreement. Lathrop moved that Council approve a revokable license agreement between the City of Louisville and the Gerrity Oil & Gas Corporation, as outlined in Council's packet, with the addition of a clause requiring a $25,000.00 performance bond to cover construction and reclamation of two wells and a tank battery in the south half of the northwest quarter of Section 9, 1 S 69. Seconded by Mayer. Howard offer a friendly amendment that Council included the statements by Councilman Sisk concerning the clarification of the language and that a clause be added that states that a barrier will be placed around the two wells near the ballfield location and that a guard be posted while the drilling operations are taking place. Lathrop: If we haven't started construction, do you think that would be necessary at that point? Or, if we have started construction of our ballfields, I think I would tend to agree with you. Howard: My problem is that it's not only relatively close to the ballfield site, but if it's an explosive well fire like we saw in Lafayette, it's still close enough to the street to possibly cause injury, if we don't have a barrier in place. Griffiths: Seconder, Mayer, accepted We just received, tonight, Exhibit A to the revokable license agreement, which are the as built plans for the pipelines. I would just ask that the city staff be given the opportunity to review those and make sure those are adequate and perhaps, as part of the motion you could say, "subject to approval by city staff or the City Public Works Director, of Exhibit A."
