NONE

Roll call was taken. Motion passed by a 7 - 0 vote.

Mayer suggested, given the local drilling activity in the
Louisville area and what's happening with the Lafayette Golf
Course, that Council soon address proposing some new regulations
for oil and gas drilling in Louisville.

ANNEXATION PETITION FILED BY STELMACH

RESOLUTION NO. 22, SERIES 1993 - FINDING SUBSTANTIAL
COMPLIANCE OF AN ANNEXATION PETITION FITmD BY STELMACH
INITIATING ANNEXATION PROCEEDINGS FOR CERTAIN PROPERTY
AND ESTABLISHING A TIME FOR A PUBLICHEARING TO DETERMINE
IF THE PROPOSED ANNEXATION COMPLIES WITH STATUTORY
REQUIREMENTS

Paul Wood, Planning Director, stated that Ms. Stelmach is
petitioning for the annexation of her 8.3 acre parcel located
directly north of U.S. 36, west of McCaslin Boulevard, and just
south of an incorporated 10 acre parcel zoned CB. The Planning
Commission held a public hearing on June $ and adopted by a vote of
4 - 1, Resolution No. 9, which recommends approval of the
annexation and zoning to CB (Commercial Business) without
condition. He stated that the Planning Commission's action was
based upon the fact that the proposed annexation is in compliance
with eligibility guidelines per the Colorado Revised Statutes and
the annexation is in compliance with the Louisville Comprehensive
Plan, updated in 1989. He stated in a general comment relating to
the Stelmach and the Morrison annexation, staff had contacted both
applicants that it would be their hope, as well as encouraged by
the Planning Commission, that at the time of site plan review and
subdivision development of the property, that the two properties
could coordinate a unified PUD development plan to address traffic
buffering, land use compatibility issues, landscaping, traffic
generation, and drainage. He explained that other comments
forwarded to the applicant deal with the need to execute annexation
agreements and dedicate any water rights, as part of the annexation
agreement, which should be executed, if Council does approve the
annexation.

Howard thought that when Council sent this to the Planning
Commission, it was done with the request to add on a proviso that
the Homart design criteria would be used on these properties.

Wood stated that he wasn't at the Planning Commission meeting and
he didn't know, specifically, if Centennial Valley design
guidelines were discussed in relationship to the property. Wood
knew that there had been heavy discussion and emphasis on the
aesthetic/visual aspects in relation to U.S. 36 and McCaslin

9
