All in favor. <br /> <br />CONTINUING DISCUSSION/DIRECTION - REQUEST FOR A RIGHT-OF-WAY <br />ENCROACHMENT ON DAHLIA STREET <br /> <br />Tom Phare, Public Works Director, stated that they have researched <br />the right-of-way encroachment on Dahlia Street from Cherry Street <br />to the Public Service power lines on the east side of Fireside <br />School. He reported that there is no encroachment on minimum site <br />distance. He pointed out that, because of the fences, there will <br />be some change in the site lines that are currently provided, but <br />they will not encroach on the minimum or the 25 mph speed limit. <br />They assume that none of the fences would be within 4 1/2 ft. from <br />the existing back of walk, because that is where there is an <br />existing fence line that's partially constructed. He stated that <br />they propose that, if Council authorizes this, they would write <br />license agreements referencing the existing back of walk. He <br />mentioned that there are a number of front yards on that section of <br />Dahlia Street, which would not apply any fencing. That would be <br />done through a license agreement and would also have to be <br />consistent with the standard fence permits, as far as side yards, <br />set backs, etc. It would not have any change on the current fence <br />code. If Council authorizes this, there would be the standard <br />language on liability and revokabliity within the license <br />agreement. He stated that it is their recommendation that <br />landscaping be addressed to make sure the landscaping wouldn't be <br />a problem in the section between the back of walk and the fences <br />and that they get the property owners to commit to maintaining that <br />in a proper manner, so that there isn't a patch of unmaintained <br />area on the outside of their fences. <br /> <br />Scott Osgood, 838 West Dahlia Court, Louisville, Colorado, stated <br />that he was approached by a neighbor (Jason Albright) that would be <br />affected by this and he was in favor of this.
