HORRISON ANNE~TION <br /> <br />Davidson: <br /> <br />Howard: <br /> <br />At the request of the City Attorney, <br />we will cover the annexation <br />agreement first. Would it stand to <br />reason that we include the same <br />things in this annexation agreement <br />as in the last one? <br /> <br />So moved. <br /> <br />Hedding seconded. <br /> <br />Susan Griffiths, City Attorney, asked the representative of the <br />owner if they were agreeable to the amendments that are being <br />proposed. <br /> <br />Chuck Bellock, representing the owner, Madeleine Morrison. <br /> <br />Bellock: <br /> <br />By approving this right now, I can <br />raise some of those concerns. I <br />would prefer he spoke to you <br />directly. Is this the final and <br />definitive document, or is there <br />room for discussion beyond this <br />time? <br /> <br />Griffiths: <br /> <br />From my understanding, this is the <br />final document. <br /> <br />Bellock: <br /> <br />In that case, while we have no water <br />rights associated with the property <br />and none required, as in paragraph <br />13, I would ask that the same <br />language be changed, so that you <br />didn't retroactively require water <br />rights or cash-in-lieu. With regard <br />to paragraph 17, where we're going <br />to indemnify and hold the city <br />harmless, that would be true except <br />for the city's acts or omissions. <br />We shouldn't be holding the city <br />harmless for its own negligence. <br />Therefore, I would request that the <br />third line of paragraph 17 <br />.... "against all liability, claims, <br />and demands, including the word <br />'reasonable' attorney's fees .... " <br />should be inserted. I also think <br />that we should not have any <br />obligation with regard to indemnify <br /> <br />12 <br /> <br /> <br />
