then, he had conferred with their architect concerning the ADA and <br />the engineer regarding the necessity for on site detention. He <br />explained that it was decided that going with a two story <br />configuration was not feasible, which makes it even more difficult <br />for them to do the kind of floor area that they want to do within <br />the 18' height restriction proposed within the AO-T. They can't <br />even get a two story structure within the 25', so they have a great <br />height concern. He commented that, when you take the 6.7 acre site <br />and deduct the 12% off the top, as an open space dedication <br />requirement, that leaves 5.9 acres. It's a very long, narrow site. <br />They would lose about 1.8 acres of that site just within the 50' <br />buffers alone, leaving them with 4.1 acres. If they were to do the <br />60% over and above those two deductions, they are left with 1.6 <br />acres. He stated that requesting a 60% medical facility out of the <br />professional building and 40% non-medical, they could only get <br />about 25,000 s.f. of professional office use on that site. He <br />stated that the amount of developable area on this site, the floor <br />area ratio would be .08, using 25,000 s.f. over 6.7 acres. Neodata <br />across the street had been approved at .31 floor area, four times <br />more dense than this property. Durham was aware that they could <br />come in as a PUD, but they preferred not to. He stated that they <br />intended to bring their proposal in to the city in 30 days or so. <br />They want to be a part of the City of Louisville. <br /> <br />Barry Morris, 650 - 12th Street, Boulder, Colorado, representing <br />Louisview Corporation, stated that he didn't believe that the <br />Council had looked at the economics of this, just the physical <br />aspects of the proposed zoning. Economically, it renders this <br />parcel useless. Their lender had virtually told them to forget it, <br />the property is sterilized and they wouldn't even consider lending <br />them money on it. He felt that it would be a more fair situation <br />for them, as well as other developers that come into Louisville, if <br />the AO zoning remained. If the Council voted down the AO-T and <br />allow them to come in with a PUD, Morris believe that Council <br />governs everything necessary, as far as the conforming of buildings <br />and roofs/pitches, designs, allowing them so much more flexibility <br />with the PUD. He asked Council to stay with the original AO <br />zoning. <br /> <br />Davidson called for Council comments or questions. <br /> <br />Susan Griffiths, City Attorney, wanted to clarify the application <br />of this ordinance, stating that this ordinance does not apply to <br />any specific parcel of property. This ordinance is not limited to <br />any specific parcel of property. The ordinance merely creates a <br />new zoned district called AO-T and will not become applicable to <br />any parcel of property until it has been rezoned in accordance with <br />the city's code or zoned initially, if the property is annexed to <br />the city. She stated that there is property outside the city's <br />boundaries that has not been annexed to the city and is not <br />currently subject to the city's zoning code.
