Blankenship didn't know. <br /> <br />Helen Peck, 1020 South Franklin, Denver, Colorado, stated that they <br />will be on public right-of-way, with a revokable license in a <br />corridor with other utilities. <br /> <br />Sisk: <br /> <br />Is there indemnification during the <br />digging operations for any other <br />affected utilities, i.e. phone <br />company or Public Service? <br /> <br />Blankenship: <br /> <br />They ' ve been addressed in the <br />license agreement and there is <br />inherent liability on the contractor <br />for notification and his <br />responsibilities, as they lie with <br />serving existing facilities. <br />Additionally, we've asked that TCI <br />provide certificate of insurance. <br />Also, we have asked, through Exhibit <br />B, that TCI provide liquid security <br />in the amount of $100,000.00 to <br />cover any damages that occur. <br /> <br />Sisk moved that Council approve the revokable license agreement <br />with TCI of Colorado, Inc., as it has been prepared, including <br />Exhibits A & B. Seconded by Howard. Roll call was taken. Motion <br />passed by a 6 - 0 vote with Hornbostel being absent. <br /> <br />APPROVAL OF CONTRACT FOR PLANNING ANALYSIS SERVICES <br /> <br />Susan Griffiths, City Attorney. <br /> <br />Griffiths: <br /> <br />I asked that this be pulled off of <br />the Consent Agenda, because we had <br />recommended a number of changes to <br />the draft services contract. Our <br />changes are not substantive in the <br />sense that they don't change the <br />amount that's to be paid under the <br />contract or the services to be <br />performed. However, we have <br />prepared a draft contractual <br />services agreement, a sample one, <br />that has been used in a variety of <br />city projects and believe that it is <br />more protective of the city's <br />interest, if it can possibly be <br />used.
