Griffiths:

The draft resolution under the
Intergovernmental Agreement, if you
ask for a public meeting, is you
should try to identify the
modifications that you want in their
proposed budget. If you have
identified those, you identify those
in the Resolution. If you haven't
identified any, it seems to me that
some general wording about they
should consider modifications
necessary to prevent increases and
the current monthly telephone
surcharge included.

Howard stated that that was so added.
that. Ail in favor.

Seconder, Mayer, accepted

APPROVAL OF LICENSING AGREEMENT - TCI

Mayer requested that this be pulled from the Consent Agenda because
he wanted Council to consider whether the value received from this
agreement, which essentially allows someone to use the city's land
for approximately two miles, with both the use of the land and the
potentiality for problems. He stated that even if the city was
reimbursed, it could still cause the city problems. He wondered
why this was in the city's interest, when for $500.00/year the city
would be opening up two miles of land for which there was no
benefit to the City of Louisville.

Dan Blankenship, City Engineer, stated that TCI's intent is to
connect their Boulder to Denver offices, with potential customers
in the Louisville area, such as CableLabs. TCI has offered to put
in a conduit, which would become city's property, for the city in
their trench, which could be used by the city for interconnecting
the city's traffic signals along the McCaslin corridor, being of
benefit of the City. That was spelled out in Item 10 in Exhibit B.

Doug Adams, Plan Engineer, TCI of Colorado, stated the fiber optic
cable that they're asking to place through Louisville is a direct
interconnect to from their facility in Boulder to their facility in
the Metroplex of Denver. He stated that, because CableLabs has
come to Louisville, they're actively participating in some
experiments and tests with them. They will dedicate several fibers
to CableLabs going back into Boulder, so they can work through both
of the facilities here. He explained that the estimated cost to
TCI to provide the conduit to the city is in excess of $20,000.00.

Mayer wondered what the going rate for accessing land for cable per
mile or foot and will the city be getting reasonable value for
that.

35
