NONE <br /> <br />Sisk moved that Council approve Ordinance No. 1116, Series 1993, on <br />2nd and final reading. Seconded by Howard. Roll call was taken. <br />Motion passed by a 6 - 0 vote with Davidson being absent. <br /> <br />ORDINANCE NO. 1117, SERIES 1993 - ESTABLISHING A LIQUOR LICENSING <br />AUTHORITY - 2ND READING - PUBLIC HEARING (PUBL. LSVL. TIMES <br />7/21/93) <br /> <br />Griffiths read by title only Ordinance No. 1117, Series 1993, "An <br />ordinance amending Chapter 5.08 of the Louisville Municipal Code <br />relating to alcoholic beverages, and creating a local licensing <br />authority." <br /> <br />Susan Griffiths, City Attorney, stated that this is the 2nd reading <br />of an ordinance that would create a citizens local licensing <br />authority that is not composed of the Council members. If the <br />ordinance is passed on 2nd reading, it would take effect, as <br />currently written, 30 days after publication. She recommended, <br />based upon Council's action with respect to the Track Inn, that <br />Council add a new section to the ordinance, which states that the <br />Council shall remain the local licensing authority for all matters <br />pending before the local licensing authority as of August 3, 1993, <br />including the renewal application of the Track Inn, in that the <br />City Council would have all powers of the local licensing authority <br />with respect to those pending matters. <br /> <br />Sisk offered an amendment on Section 3, Chapter 5.08.080, sub- <br />section D, by deleting the words" .... or without .... ,, He didn't <br />feel the Council should be in the position to remove a license <br />board member without cause. Seconded by Lathrop. <br /> <br />Mayer asked for the definition of "cause" in this case. <br /> <br />Griffiths: <br /> <br />There is really no definition of <br />"cause", because I didn't feel it <br />was needed, when the statement was <br />" .... with or without cause." If one <br />takes out" .... without cause," then <br />it only permits removal for cause, <br />then we really don't know what cause <br />is other than it likely be failure <br />to perform the duties that they have <br />under the ordinance itself. <br /> <br />Mayer: <br /> <br />I never like drafting legislation on <br />the fly, especially at 2nd reading. <br />If there is really a feeling that <br />this should be added, I would prefer <br />to table this tonight and have the <br /> <br />5 <br /> <br /> <br />
