Howard moved that Council accept Ordinance No. 1117, Series 1993, <br />amending Chapter 5.08 of the Louisville Municipal Code with the <br />amendment that the City Council will remain the liquor licensing <br />authority for matters pertaining prior to and including August 3, <br />1993, as amended. Seconded by Mayer. <br /> <br />Griffiths: <br /> <br />For clarification, the renewal <br />application on the Track Inn license <br />would be handled by the City Council <br />acting as the local licensing <br />authority on September 21. Is that <br />correct? <br /> <br />Sisk: Correct. <br /> <br />Roll call was taken. <br />being absent. <br /> <br />Motion passed by a 6 - 0 vote with Davidson <br /> <br />DISCUSSION ON RESIDENTIAL GROWTH POLICY <br /> <br />Hornbostel stated that in talking to people, she has found out that <br />people are very concerned about growth, the rate of growth, and why <br />Louisville is growing. She explained that part of the growth has <br />to do with three master plans that were done: Homart and McStain <br />master plans were done in the early '80's; the Coal Creek Ranch One <br />was done in the mid 80's. When the property is approved by being <br />annexed and zoned, that developer has vested rights to develop that <br />property. Therefore, it is hard for Council, in terms of once a <br />property has been annexed and zoned, the only thing Council can do <br />is to determine what it looks like through a PUD hearing. Before <br />property is annexed, Council has a lot of flexibility of things <br />that they can do, such as the Meadows, in terms of the density, <br />they negotiated a park site there, and they asked them to do <br />"phasing." She felt that one of the problems has been enclaves. <br />Hornbostel submitted and read her proposal for a growth policy (SEE <br />ATTACHED). <br /> <br />Howard: <br /> <br />The five year period (in the <br />proposal) goes over more than one <br />Council term. Can one Council bind <br />another in that fashion? <br /> <br />Susan Griffiths, City Attorney, stated, off the top of her head, <br />because she had not seen this document before this meeting, that it <br />is very unlikely that a Council can bind the legislative decision <br />as to whether or not to annex property, as the question of <br />annexation is considered to be a legislative decision. There would <br />be a substantial legal question as to whether this would be <br />enforceable against future Councils. <br /> <br />Howard: <br /> <br />I'm fundamentally in favor of <br />stopping the growth and have always <br /> <br />7 <br /> <br /> <br />
