The Old Town Overlay did not amend the minimum lot area and width requirements in the <br />RL district. <br />PROPOSAL: <br />The property owners are requesting a variance to split the existing 15,000 SF, 100 -foot <br />wide lot into two lots: <br />• Lot 1 would be 8,625 SF and 57.5 feet wide; <br />• Lot 2 would be 6,375 SF and 42.5 feet wide; <br />This request requires variances from the minimum lot size and minimum lot width <br />requirements documented in the RL zone district. The RL zone district requires a <br />minimum lot width of 70' and lot area of 7,000 SF. Therefore the applicant needs lot width <br />variances for both lots and a lot area variance for Lot 2. <br />If the variance requests were to be approved by the Board, a minor subdivision replat <br />application would need to be submitted and approved through the Planning Commission <br />and City Council public hearing processes. Upon approval of a minor subdivision plat, the <br />property owner(s) would be allowed to apply for building permits for any new construction. <br />Building permits would be reviewed for compliance with all requirements of the Old Town <br />Overlay. <br />Because it is an interior lot, both proposed new lots would continue to get access off of <br />Roosevelt Avenue. The specific proposed dimensions for the lots are a result of arranging <br />the lot lines so the existing house may be kept and comply with setback requirements. <br />If the property were to remain as a 15,000 SF property, the Old Town Overlay would <br />permit the construction of up to four units covering approximately 4,500 SF and a total floor <br />area of 5,250 SF. Under the proposed subdivision, Lot 1 would allow two units covering <br />2,587.5 SF with a floor area of 3,018.75 SF while Lot 2 would allow one unit covering <br />2,231.25 SF with a floor area of 2,699 SF. <br />REVIEW CRITERIA: <br />The BOA has authority to hear and decide, grant or deny this application for a variance <br />from Section 17.12.040 of the LMC by the powers granted the BOA in Section 17.48.110 <br />of the LMC. The BOA may grant a variance only if it makes findings that all of the criteria, <br />as established under Section 17.48.110.B.1 -6, have been satisfied, insofar as applicable: <br />The applicant has provided a written analysis of the variance criteria, which has been <br />included in the BOA packet materials. Following is a staff review and analysis of the <br />variance criteria. <br />1. That there are unique physical circumstances or conditions such as irregularity, <br />narrowness or shallowness of lot, or exceptional topographical or other physical <br />conditions peculiar to the affected property. <br />3 <br />
