sewer is brought closer, it would be hard for them financially to <br />tie into the sewer line. <br /> <br />Davidson stated that he would like to see that one acre as part of <br />the City of Louisville. The desired use that the Scriffiny's have <br />for the property fits very well with the plans for low density in <br />that area. <br /> <br />Davidson called for Council comments or questions. <br /> <br />NONE <br /> <br />Sisk moved that Council refer the annexation request to the <br />Planning Commission with a notation regarding the RR zoning and the <br />one home maximum on that either by way of an agreement with the <br />Scriffinys, which would be a covenant running with the land and <br />would be binding on successors, heirs, and assigns, or with, if the <br />new zoning is in place, which would be the proper zoning whereby <br />the same use would be permitted, and if something unfortunately <br />happened to the Scriffiny's home, then the home could clearly be <br />rebuilt. Seconded by Hornbostel. <br /> <br />Mayer offered a friendly amendment that it be RRR zoning. <br /> <br />Sisk accepted that, as did the seconder, Hornbostel. <br /> <br />Ail in favor. <br /> <br />ANNEXATION PETITION FILED BY BEATON <br /> <br />RESOLUTION #34, SERIES 1993 - TIMOTHY AND BARBARA BEATON - <br />BEATON ANNEXATION <br /> <br />Paul Wood, Planning Director, stated that this is for .66 acres <br />(28,750 s.f.) located 150 ft. west of McKinley Avenue, south of the <br />Walnut Street extension. Surrounding, incorporated properties are <br />zoned RE and RL to the north and east respectively. The 2.5 acre <br />parcel to the north was annexed in 1986 as the Wigget annexation. <br />The property owner is seeking to incorporate their parcel into/with <br />as joint application to the north, which is Bridgefield East, the <br />platting and PUD process, which is on track to come before the <br />Planning Commission in October. If authorized under a RE zoned <br />district, which is the request of the applicant, that property <br />would then be able to contribute two lots to the proposed <br />subdivision. The total plat and PUD would total 3.27 acres. The <br />legal description of the property calls out an area of .77 acres. <br />The difference of .011 acre (4,792 s.f.) is within the Beaton fence <br />line and is incorporated and zoned RL. He stated that they would <br />want to see the zoning of that strip of property be consistent with <br />whatever zoned district this property ultimately gets zoned to. <br /> <br />Davidson called for the applicant's presentation. <br /> <br /> <br />
