Walnut Street, Boulder, Colorado, was present to represent the <br />applicant. <br /> <br />Linda Salas, Clerk to the Authority, stated that 1006 Pine, Inc. <br />operates the Track Inn located at 1006 Pine Street, Louisville, <br />Colorado. Their tavern license expires October 13, 1993, and the <br />applicant had filed their application for renewal of their license. <br />The Council had in their packets a copy of the completed <br />application and a related police summary dated July 28, 1993. The <br />Licensing Authority first considered the renewal application at its <br />meeting of August 3, 1993. At that time the Authority scheduled a <br />hearing for tonight at this meeting on the application. Notice of <br />the hearing was conspicuously posted on the licensed premises for <br />a period of 10 days prior to this hearing. Written notice of the <br />hearing was mailed certified to the applicant on September 9, 1993, <br />more than 10 days prior to this hearing. Salas had delivered to <br />the Track Inn on September 20, 1993, and mailed by certified mail <br />to the applicant's Lafayette address, a notice dated September 20, <br />1993, informing the applicant that Mr. Bruce Joss had been retained <br />to represent the Police Department at this renewal hearing, and <br />included a summary of the Police Department reports for the period <br />subsequent to the July 28, 1993.~ Salas had also sought to reach <br />the applicant by telephone to provide that notice. <br /> <br />Davidson moved that the complete renewal application for the Track <br />Inn, including the July 28, 1993, summary from the Police <br />Department and the September 9 and 20, 1993, notices, which the <br />Clerk provided the applicant, be made part of the record for this <br />hearing. Seconded by Howard. <br /> <br />Davidson asked if anyone present objected to the motion. <br /> <br />Humphrey stated that the applicant objected. He commented that <br />under the statutes it states that the applicant be given 10 days <br />advance notice of the nature of the proceedings that will be <br />considered with regard to the application for renewal. He stated <br />that the letter of September 20, 1993, was hand delivered to the <br />applicant that day, setting forth four additional "incidences" to <br />be considered by the Authority, with regard to the renewal <br />application. Humphrey explained that they had not had the <br />opportunity to review the facts and circumstances that were <br />referenced in the report. For that reason, he objected to <br />consideration of these additional incidences. As an alternative, <br />he suggested moving for a continuance of this hearing. They also <br />had citizens of Louisville wishing to give testimony in support of <br />the renewal of the application, but because of the late hour of the <br />public hearing, they had been dissuaded from coming to the meeting. <br /> <br />Susan Griffiths, Attorney for the Authority, stated that there are <br />two separate issues. The motion is to make a part of the record of <br />this hearing the complete renewal application and the two notices, <br />which the Clerk provided.
