Davidson called for further Council comments. <br /> <br />NO~ <br /> <br />Davidson moved that Council preliminarily approve Resolution No. <br />36, Series 1993, authorize the Mayor to sign the accompanying <br />letter, send it out to the residents of Louisville for comment, and <br />set a further consideration of Resolution No. 36 at the first <br />meeting in November, subject to the previously noted change. <br />Seconded by Howard. Roll call was taken. Motion passed by a 7 - <br />0 vote. <br /> <br />COS~INUEDPUBLIC HEARING -RENEWAL OF TAVERN LIQUOR LICENSE - TRACK <br />INN <br /> <br />Davidson stated thatthe Liquor Licensing Authority is represented <br />by Attorney Susan Griffiths. Attorney Bruce Joss was present to <br />re~resent the Louisville Police Department. <br /> <br />Cl~ Patzer, President and principle shareholder in the 1006 Pine <br />Co~oration, the applicant was present, as was their attorney <br />Donald Humphrey, partner in the law firm of Martin & Mchaffy, <br />Boulder, Colorado. <br /> <br />SuE~an Griffiths, Attorney for the Liquor Licensing Authority, <br />stated that this is a continuation of a hearing that was opened <br />originally on September 20, 1993 and was continued at the request <br />of the applicant until this date. This continued hearing was to <br />consider the application of 1006 Pine, Inc., and the City Council <br />wa~: acting as in a quasi-judicial capacity as the local Licensing <br />Authority under state law. The Authority's decision at this <br />meeting must be based on the evidence presented to it at the <br />hearing and the legal requirements set out by state law. Griffiths <br />stated, as a reminder, that all of the non-attorney witnesses would <br />be sworn in at this meeting by the City Clerk. <br /> <br />Davidson asked theLouisville's Police Department's attorney, Bruce <br />Jo~s, if the Police Department had any presentation to make to the <br />Authority, including any documents or witnesses. <br /> <br />Bz~[ce Joss, attorney for the Louisville Police Department, stated <br />that they had one witness, and that the Authority had already <br />received the memorandum dated September 16, 1993, which they would <br />be referring to during this hearing, and there may be some <br />add[itional documents to present during the testimony. <br /> <br />Gri.ffiths reviewed the documents contained in Council's packet on <br />this item (SEE ATTACHED), stated that? these are the type of <br />documents the Authority receives and considers prior to each <br />renewal application. Also made a part of the record at the opening <br />of the hearing on September 20, 1993, was a September 20 notice to <br />the applicant advising the applicant regarding the retention of <br /> <br /> <br />
