Griffiths stated that it was an Ordinance amending Title 17 of the <br />Louisville Municipal Code and Title Zoning by zoning property owned <br />by tendency known by Timothy and Barbara Beaton known as the Beaton <br />Annexation. <br /> <br />Davidson then opened the public hearing. Staff comments have <br />already been made. He then asked for audience participation. <br />No one wanted to speak, so the public hearing was closed and he <br />asked for Council comments, questions and motions. <br /> <br />Ho~'ard moved that the Council approve Ordinance No. 1123, Series <br />1993, zoning of annex property, Beaton property, on second and <br />final reading. Seconded by Lathrop. Roll Call Vote. Yes: <br />Hornbostel, Howard, Lathrop, Mayer, Hedding, and Davidson, 5/0, <br />pas, sed. <br /> <br />ORDINANCE NO. 1128, SERIES 1993 - COAL CREEK RANCH FILING NO. 1 - <br />VAf~TION OF UTILITYAND PEDESTRIAN ACCESS EASEMENT - 2NDREADING - <br />PU~LIC HEARING (PUBL. LSVL. TIMES 10-9-93) <br /> <br />Griffiths indicated this was an Ordinance transferring by quick <br />claim deed any title and interest of the Louisville in an easement. <br /> <br />Davidson opened the public hearing and asked Paul Wood to present <br />the staff presentation. <br /> <br />Wood indicated that this ordinance came to the Council for second <br />reading tonight. It was approved on first hearing on October 6. <br />It is a request by the applicant, Coal Creek Associates, to release <br />the City's interest in a portion of a ten foot emergency access and <br />utility easement on Lot 90 of Coal Creek Ranch Filing 1 or also <br />known as 630 Manwood Lane. The purpose of the release of the <br />eas. ement would be to remedy a building encroachment. The applicant <br />is in the audience. <br /> <br />Davidson then requested audience participation either in favor or <br />against this ordinance. There were none, so the public hearing was <br />closed and the asked for Council comments, questions, and motions. <br /> <br />Hed.ding made a motion that Council adopt Ordinance 1128, Series <br />1993, transferring title and interest in the easement to Coal Creek <br />Ranch Filing No. 1, Lot 90, second and final reading. Seconded by <br />Lathrop. <br /> <br />Mayer said that he felt that since this was an error on the part of <br />the applicant and City time was expended some compensation to the <br />City is due in a reasonable amount of $100. I put that in the form <br />of a motion. Seconded by Hornbostel. <br /> <br />Davidson then repeated the amendment to the motion to include $100. <br />The first vote will be on the amendment. Griffith made the <br />statement that they were not amending the ordinance, but a motion <br /> <br />5 <br /> <br /> <br />
