I hope by December 7 <br />we'll see some significant inroads <br />in terms of compliance with the <br />present franchise agreement. <br /> <br />Hornbostel called for any other comments. <br /> <br />NONE <br /> <br />Ail in favor of the motion with Mayor Davidson being absent. <br /> <br />RESOLUTION NO. 45, SERIES 1993 - AMENDMENT TO THE REPLAT OF THE <br />DUTCH CREEK SUBDIVISION PLAT <br /> <br />Paul Wood, Planning Director, stated that the applicant, Roberta R. <br />Martine, was requesting the elimination of an existing plat <br />restriction on Tract R of the Dutch Creek Subdivision Replat <br />prohibiting the construction of single family detached homes. The <br />applicant had obtained new information from CTL/Thompson, geo- <br />technical engineers, stating that Tract R was not directly <br />underlain by the Acme Coal Mine and that the parcel would be <br />suitable for the construction of a single family residence, so the <br />applicant would like the Plat restriction removed. Tract R, 7,830 <br />s.f., is in compliance with the minimum lot size requirements for <br />Dutch Creek. Planning Commission, at their October 21, 1993, <br />meeting, approved Resolution No. 23, 3 - 2 vote, with one <br />condition: Any structure constructed subsequent shall be <br />architecturally consistent with existing houses in the subdivision. <br /> <br />Robert R. Martine, 294 Lilac Circle, Louisville, Colorado, stated <br />that a Quiet Title had been completed in the Boulder County <br />District Court, which struck the restrictive language from the <br />deed. The property is now hers with no restrictions on it. <br /> <br />Lathrop was concerned about the neighbor's view being obstructed. <br /> <br />Martine: <br /> <br />Anybody's view right now of the open <br />space is through their backyard or <br />through their front window. The <br />only possible view that could be <br />obstructed is through somebody's <br />backyard. I would orientate the <br />house, so that it also would have a <br />backyard, so you could view through <br />the backyard. <br /> <br />Howard wondered if the city had any additional liability, other <br />than what they currently have concerning this property. <br /> <br />Susan Griffiths, City Attorney, stated that she didn't see any <br />expanded liability on the part of the city for taking this action. <br /> <br />8 <br /> <br /> <br />
