Griffiths: <br /> <br />Councilman Howard should listen to <br />the public hearing and the <br />discussion of this meeting before he <br />acts. He can act on it if he <br />listens to the tape recording of <br />this portion. <br /> <br />Mayer asked that Councilman Howard be so advised. <br /> <br />Davidson called for further discussion. <br /> <br />NONE <br /> <br />Ro].l call was taken. Motion passed by a 3 - 1 vote with Davidson <br />voting against, Howard being absent, and Sisk and Lathrop being <br />excused due to a conflict of interest. <br /> <br />Shonkwiler explained about the delay on the completion of McCaslin <br />Bo=[levard. Homart was asked by the city to delay the project <br />because one of the adjacent Enclave property owners wanted some <br />enhanced service to his property. It was delayed until he could be <br />accommodated, which took about six or seven weeks to redesign and <br />re-.bid the project. It will be completed as soon as the weather <br />gets warmer. <br /> <br />Davidson moved that Council re-open the pubic hearing on December <br />9, 1993, since there will be a slight difference in Homart's plan. <br />Seconded by Mayer. All in favor with Howard being absent and Sisk <br />and[ Lathrop being excused due to a conflict of interest. <br /> <br />BPm~K <br /> <br />Davidson called for a five minute break. <br /> <br />Davidson called the meeting back to order. <br /> <br />U.S. WEST LITIGATION <br /> <br />Davidson stated that the City Attorney had advised him of a date on <br />the U.S. West litigation. <br /> <br />Davidson moved that Council reconsider approval of the Agenda. <br />Seconded by Sisk. All in favor with Howard being absent. <br /> <br />Davidson moved to add to the Agenda consideration of the settlement <br />with U.S. West litigation. Seconded by Sisk. All in favor with <br />Howard being absent. <br /> <br />Sus~an Griffiths, City Attorney, stated that she had just been <br />advised that the U.S. West personnel have agreed to a settlement <br />(Griffiths reviewed the basis for the suit). The settlement would <br />be that the city and U.S. West now agree that $27,500 is the <br /> <br />7 <br /> <br /> <br />
