Griffiths: Councilman Howard should listen to the public hearing and the discussion of this meeting before he acts. He can act on it if he listens to the tape recording of this portion. Mayer asked that Councilman Howard be so advised. Davidson called for further discussion. NONE Ro].l call was taken. Motion passed by a 3 - 1 vote with Davidson voting against, Howard being absent, and Sisk and Lathrop being excused due to a conflict of interest. Shonkwiler explained about the delay on the completion of McCaslin Bo=[levard. Homart was asked by the city to delay the project because one of the adjacent Enclave property owners wanted some enhanced service to his property. It was delayed until he could be accommodated, which took about six or seven weeks to redesign and re-.bid the project. It will be completed as soon as the weather gets warmer. Davidson moved that Council re-open the pubic hearing on December 9, 1993, since there will be a slight difference in Homart's plan. Seconded by Mayer. All in favor with Howard being absent and Sisk and[ Lathrop being excused due to a conflict of interest. BPm~K Davidson called for a five minute break. Davidson called the meeting back to order. U.S. WEST LITIGATION Davidson stated that the City Attorney had advised him of a date on the U.S. West litigation. Davidson moved that Council reconsider approval of the Agenda. Seconded by Sisk. All in favor with Howard being absent. Davidson moved to add to the Agenda consideration of the settlement with U.S. West litigation. Seconded by Sisk. All in favor with Howard being absent. Sus~an Griffiths, City Attorney, stated that she had just been advised that the U.S. West personnel have agreed to a settlement (Griffiths reviewed the basis for the suit). The settlement would be that the city and U.S. West now agree that $27,500 is the 7
