Mayer was concerned that this had gone on for three months. If it
were continued until January, it would be four months. He felt it
was time to expedite the matter.

Howard felt the applicant should have previously requested a work
session with Council.

Zukaitis felt he wanted to do that.

Hornbostel explained to Zukaitis that it wasngt that Council didn't
understand that he wanted to bring in two houses, it was that the
zoning Zukaitis asked for would allow three. At a later time,
someone could come in and have that zoning for three houses instead
of two.

Peter Kernkamp, Planner, stated that the Planning Commission
recommended RR zoning, because of the access constraints, it was
only appropriate for one house. In the Planning Co~issiongs
discussion they indicated that some sort of a PUD with the adjacent
undeveloped property that improves the access to the property and
at that point two units might be appropriate.

Davidson suggested that Council continue this until January 4,
1994.

Sisk suggested that Council continue this until January, 4, 1994,
or, as an alternative, allow Mr. Zukaitis to resubmit a plan that
would go through the Planning Commission wherein the City would not
charge Mr. Zukaitis the extra fees that would be required normally
with a new one.

Davidson opened the public hearing calling for anyone in the
audience wishing to speak in favor or against Ordinance No. 1126.

NONE

Howard moved that Council continue this hearing until January 4,
1994, at which time the applicant can either come before Council
with additional presentation time allowed or with no additional
city costs to the applicant, and at that time choose to start the
process over again. Seconded by Sisk. Roll call was taken.
Motion passed by a 5 - 2 vote with Davidson and Hornbostel voting
against. Davidson clarified his vote by saying that he was in
favor of continuing the hearing, but not in favor of waiving the
city fees.

ORDINANCE NO. 1127, SERIES 1993 - AN~NDING TITLE 17 OF THE
LOUISVI?.?.~MUNICIPALCODEENTITLED mZONINGm BY ZONING PROPERTY
OWNED BY THOMASP. ZUK~ITISKNOWNASTHEZ~TIS~TION -
2ND READING - PUBLIC HEARING - (REQUEST TO CONTINUE TO
1/18/94)
