Wanush stated that. this Ordinance zones the property <br />under consideration for annexation as PCZD. Wanush <br />asked that his testimony given during the <br />presentation for Ordinance #948 be also considered <br />for this Ordinance #949. This PCZD zoning is a <br />special type of zoning that essentially is <br />regulated not by zoning ordinance itself, but by the <br />General Development Plan and the agreements that are <br />associated with that Plan. <br />Mayor Fauson asked for public comments on this <br />Ordinance. <br />Pat Hornbostel, 655 W. Hawthorn, commended Council <br />for postponing final action on the Coal Creek <br />Project until all documents are in and approved. <br />With no further comments from the public and no <br />Council comments, Mayor Fauson closed the public <br />hearing and called for a motion. <br />Carnival moved and Szymanski seconded to continue <br />the Council Meeting to March 9, 1988 for final <br />consideration on Ordinance #949. The motion passed <br />5-0. <br />AMENDMENT TO HOMART DEVELOPMENT <br />AGREEMENT Wanush explained ghat approximately 14-16 acres of <br />existing Parcel Q .is proposed to be changed from a <br />"residential" designation to an "open space" <br />designation. At t]he same time, a 12-14 acre portion <br />of existing Parcel S3 is being changed from "open <br />space" to "commerc:ial." This action amending the <br />plan is the first ;step required to implement a land <br />trade between Homa:rt and the City. This land trade <br />will add 14-16 acres to the proposed golf course in <br />exchange for 12-14 acres of commercial ground. <br />The Use Guidelines for Parcel 53 include those uses <br />that shall not be permitted and uses that shall be <br />permitted as a use by special review. The Design <br />Guidelines include building, site and landscape <br />design provisions :including the provision that the <br />property shall be planned under the PUD provision of <br />the Louisville Zoning Ordinance. <br />Hundley pointed oui~ that Dave Stahl of Homart <br />Development Corp. has worked with the City and the <br />developers of Coal Creek to put together this <br />Agreement to accomnnodate the proposed golf course. <br />Hundley also noted that reduction by 80 units in <br />Homart's total residential numbers is really an <br />offset to 450 residential units of Coal Creek. The <br />net effect in the number of units at the Coal Creek <br />10 <br />
