Development Co., wherein Mr. Stahl states that <br />Homart will advance. $12,500 to be used as interim <br />financing for the design fees associated with the <br />golf course project until the revenue bonds are <br />sold. This letter is authorizing the City of <br />Louisville to tran:fer $12,500 from their escrow <br />fund to the appropriate golf course account. <br />Sackett and Anderson abstained from discussion on <br />this item due to possible conflict of interest. <br />Mayor Fauson moved and Scarpella seconded to <br />authorize the Mayor to sign the letter from Homart <br />Development Co. authorizing the City to transfer <br />$12,500 from the escrow fund to the appropriate <br />golf course accounts as an advance to be used as <br />interim financing f`or the design fees associated <br />with the golf course project until the revenue <br />bonds are sold. 'The motion passed 4-0-2 with <br />Anderson and Sackettt abstaining. <br />PUBLIC COMMENTS John Mayhoffer,10014 Empire Dr., Lafayette, <br />addressed Council stating that a culvert recently <br />installed by the Public Works Department on <br />Mayhoffer land was inadequate and is requesting <br />that they increase the size. Mr. Mayhoffer sited <br />a civil court action wherein it was determined <br />that the City can not interfer with ditches unless <br />a settlement has beesn negotiated with the owner of <br />the ditch agreeing i.o the terms. <br />The City constru<:ted a driveway to the new <br />building at the sewer plant and in doing so <br />installed a 12" culvert which in Mr. Mayhoffer's <br />opinion is unsatisfactory for the use in that <br />ditch. Although the Public Works Department <br />determined that the 12" culvert is satisfactory, <br />Mr. Mayhoffer stated that an 18" culvert is <br />necessary to carry the water. A 24" culvert is <br />preferred as it wou]'.d be maintenance free. <br />Mayor Fauson asked staff to research this issue <br />and asked Mr . Mayh.of f er to be at a meeting of <br />Council Thursday, May 5th for further discussion. <br />COUNCIL COMMENTS AND COMMITTEE <br />REPORTS None. <br />RECESS At 12:02 a.m., Mayor• Fauson moved that the meeting <br />recess and asked Council to move into an Executive <br />Session. <br />EXECUTIVE SESSION Upon returning from Executive Session, Mayor <br />Fauson reopened the City Council Meeting. <br />14 <br />
