Staff is seeking <br />Council permission to place Ordinance #970 out for <br />publication and a public hearing set for November <br />1, 1988. <br />Stahl explained that Ordinance #970 revises the <br />section of the Municipal Code requiring all water <br />rights assigned to all parcels of land proposed <br />for annexation be transferred to the City at the <br />time of annexation. The proposed revision <br />provides for the Council to decide the timing of <br />the transfer of the water rights and if it is more <br />desirable than a cash-in-lieu payment. A cash <br />payment may enable the City to acquire water <br />rights of a higher quality than could be obtained <br />from the dedication requirement. A revised water <br />policy will be included for Council review at the <br />public hearing. <br />Mohr moved and Carnival seconded to place <br />Ordinance #970, Series 1988 out for publication <br />and a public hearing set for November 1, 1988. <br />Motion passed unanimously. <br />RESOLUTION #38 - BLUE PARROT - SPECIAL <br />REVIEW USE Read in its entirety, Resolution #38, Series 1988, <br />"A Resolution approving a Special Review Use for <br />the Blue Parrot Cafe." <br />Franklin explained that the Blue Parrot Restaurant <br />is allowed to replace the original sign on the <br />corner of the building. However, signs destroyed <br />by fire cannot be replaced in their non-conforming <br />configuration without approval of Planning <br />Commission and City Council. The applicants <br />request Special Review Use to replace the <br />projecting sign on N[ain Street at the historic <br />square footage while changing the copy. They also <br />request approval to replace stained glass window <br />signs (parrots) which exceed the 25$ limit in the <br />Code. Planning Commission has reviewed this <br />request and approved. same. <br />Mayor Fauson moved a.nd Ferrera seconded to adopt <br />Resolution #38, Series 1988.
