virtue of the open space holdings the City cur-
rently has. HundlE~y suggested that this land also
needs to be brought: into the Louisville Fire Pro-
tection District.
Chuck Schmidt, Chief of the Louisville Fire
Protection District:, stated that there are two
reasons behind thi;a request: 1) a second station
will be built approximately a quarter mile from
this property which will give the businesses in
the area a much bei:ter response time; and 2) the
City has adopted the National Fire Protection
Code. The Homart property is currently in the
Cherryvale Fire Prc>tection District which operates
under a different :yet of codes. In addition Louis-
ville would then be dealing with an official from
the Cherryvale Agency for building/fire inspec-
tions. Schmidt started that all annexed City of
Louisville property should be covered by one fire
protection agency.
Dave Stahl, represE~nting Homart Development Co.,
stated that in 1989E, Louisville Associates, the
predecessor to Homart Development Co., requested
that this property be included in the Louisville
Fire Protection District. Stahl reiterated that
request stating that it would be important for
them to be included in the LFPD. Stahl requested
that they have an opportunity to review all
documents, petitions, correspondence, etc. that
may relate directly to Homart property before
going to district court, LFPD or Cherryvale Fire
Protection Agency.
In response to Sac}cett's question regarding
Council's role/responsibility in this action,
Rautenstraus stated that the governing body of
the municipality iri which land has been annexed
can petition district court to be excluded from
one district and put into the other district.
When districts are formed, they are formed through
the district court. The City would have to
petition the court to take this action and the
LFPD is asking that: the City Council sanction that
step.
Mayor Fauson asked if in the future annexation
agreements could include a section wherein if the
property is outside' the LFPD, the property owners
would automaticall~~ take care of this as part of
annexation. Rauteristraus concurred.
Szymanski asked if it might be advantageous to take
other properties (properties recently annexed that
also remain outsidE~ the LFPD) to district court at
3
