The School District is agreeing to provide up to <br />$50,000 for work related to drainage. Bids for <br />the drainage project will be in next month, <br />according to Phare:. Mohr suggested that if this <br />is a project which might be billed out at a later <br />date, that language be included within the <br />agreement to cover possible price increases. <br />Anderson expressed concern with the two figures <br />used within the language of the Agreement <br />concerning cessation occurring within 25 years of <br />the original opening date of a school building, <br />and the deeding of the property back to the City <br />in the event that the School District does not use <br />the property for a school site within eight (8) <br />years of the Agreement date. "What is the magic <br />in those two numbE~rs," Anderson asked. Wanush <br />felt that they weren't particularly significant <br />and could probably be negotiated. Anderson asked <br />that staff see if those numbers couldn't be <br />"tightened" somewhat. <br />Szymanski asked what constitutes a school related <br />use as stated in Section 10.7. Wanush stated that <br />he would have that. clarified. <br />In referring to Suction 10.7, Anderson stated that <br />only having 90 days prior written notice to the <br />City with "the right of first refusal to purchase <br />shall terminate 9(1 days after the day the School <br />District gives notice" isn't a long enough period <br />to carry out the proper City of Louisville budge- <br />tary process necessary to perform in terms of a <br />closing should the: City decide to purchase the <br />facility. Staff will negotiate a longer term or <br />structure the process to better accommodate the <br />City's budgetary procedures. <br />Mayor Fauson moved that staff finalize the <br />agreement with they stated amendments for final <br />Council approval. Scarpella seconded. Unanimous. <br />REFERRAL - COAL CREEK <br />RANCH Anderson asked to be excused from the proceedings <br />on this issue as Mr. Bellock is a client of <br />Anderson's. <br />Sackett asked also to be excused due to his <br />relationship with Boulder Memorial Hospital and <br />the development oi: a health center in close proxi- <br />mity to the proposed Coal Creek Ranch site. Mayor <br />Fauson asked that he remain as his interest was <br />not monetary in nature and that if he so chose, he <br />could refrain from commenting on the proposal. <br />3 <br />
