Wanush explained thhat the applicant is requesting
the annexation of <~ two acre parcel located at 8330
Cherry Street. ThEa Planning Commission reviewed the
annexation proposa]L and found it to be in compliance
with State statues and City ordinances. They
recommend that the Council approve the annexation
subject to the fol]Lowing conditions: 1) the parcel
be developed under a single PUD; 2) the development
be consistent and compatible with surrounding
development guidelines; 3) all water rights be
dedicated; 4) 12$ of the land be dedicated or cash
in lieu (Wanush recommended cash in lieu since
there is no foreseeable use for public land on that
2 acre site); and ~~) service expansion fees be paid.
Don Shonkwiler, McCormac Development, 720 Burbank,
Broomfield, stated that Wanush's presentation of the
request was complete. Mr. Shonkwiler reminded
Council that at they Louisville Futures Conference,
it was determined ghat a high priority was
affordable property for attracting businesses to
Louisville. Mr. Shonkwiler feels that this property
will offer that to the business community.
Mayor Fauson asked for anyone wishing to speak
either in favor of or in opposition to Ordinance
#930. None.
Mayor Fauson closed the public hearing and called
for a motion.
Mohr moved that Ordinance #930 be adopted on final
reading. Mayor Fauson seconded. By Roll Call Vote,
Ordinance #930 was adopted unanimously.
ORDINANCE #931 - ZONING - RICHMOND PROPERTY -
PUBLIC HEARING Rautenstraus read by title only Ordinance #931, "An
Ordinance amending Title 17 of the Louisville
Municipal Code entitled "Zoning" by zoning property
or approximately 2.~0 acres owned by Lynda K.
Richmond." Proper publication and notice of public
hearing were determined and Mayor Fauson opened the
public hearing.
Wanush stated that Council is being asked to zone
the property Commercial-Business (CB). The property
is surrounded on two sides by Homart's Parcel O,
their highest density Parcel. The Planning
Commission reviewed. this and recommends the CB
zoning. Wanush asked that his comments regarding
the Richmond annexation during the preceeding Agenda
Item be considered as part of the record for this
Agenda item.
2
