Szymanski stated that in his opinion this is a <br />deviation from normal procedure. <br />Rautenstraus stating that the recorded plat went <br />through the normal channels, Planning Commission and <br />Council, and it is the same plat and remains <br />unchanged. <br />Szymanski stated that these issues need to be worked <br />out at a Work Session and does not feel it is <br />appropriate to go ahead with a subdivision without a <br />signed agreement whE~re all issues have been <br />addressed and agreed' to. <br />Mohr stated that evE~rything about the subdivision <br />has gone through the normal process and the only <br />issue is that of the detention area. "Rather than <br />hold up the project .at a time when the weather is <br />very favorable...I would support the position that <br />we move forward witYi the exception that you <br />suggested." <br />Hundley suggested that the Mayor and City Clerk be <br />authorized to file subdivision agreement which <br />would specify the contingency relating to the treat- <br />ment of the storm drainage area and allow Homart to <br />begin Phase I of the project. <br />Mayor Fauson stated that he is not sure why the City <br />would want to sod and irrigate a drainage area; <br />hopefully, Homart can answer that at a Work Session. <br />"At this point I would be against sodding and <br />irrigating a drainage area because we've never done <br />that in the City before..." <br />Stahl stated that the City has done this before as <br />in the case of Lake Park. <br />Mayor Fauson moved that the Council allow Homart to <br />proceed with Phase I of the Cherrywood Subdivision <br />and authorize the Mayor and City Clerk to execute <br />the subdivision agreement with the stipulation that <br />there would be a provision regarding the drainage <br />area and that issue would be resolved prior to the <br />development of Phase II. Mohr seconded. <br />Szymanski stated that he has concern over the issues <br />that are involved here and not knowing the full <br />ramifications of the issues he would not be in favor <br />of this motion and feels it more appropriate to wait <br />until Council reviews all aspects at a Work Session. <br />The motion was adopted 6-1 with Szymanski voting no. <br />7 <br />
