Mohr seconded. <br />Szymanski asked if having a First Reading, <br />publishing the Ordinance and setting a Public <br />Hearing constituted acceptance of the Ordinance <br />with the stipulations recommended by the Planning <br />Commission. Mayor Fauson explained that the <br />conditions would not become part of the Ordinance. <br />Rautenstraus stated that the annexation agreement <br />for this ordinance will be presented to Council in <br />conjunction with the ordinance upon Second <br />Reading. The annexation agreement will have the <br />conditions stipulated by the Planning Commission <br />and the Council's options are to approve, reject, <br />or amend the agreement in conjunction with dealing <br />with the ordinance. Szymanski asked if it would <br />be more appropriate to discuss the proposed <br />annexation ordinance and Planning Commission's <br />conditions at the i_ime of the Public Hearing. -. <br />Rautenstraus concurred. <br />The suggested action is to consider the annexation <br />on First Reading and set a Public Hearing for <br />April 15, 1986. <br />Szymanski indicated that he questions some of the <br />suggested conditions and is concerned with <br />approving the Ordinance on First Reading. <br />Rautenstraus stated'. that under the State Statutes <br />an Ordinance is considered on First Reading and a <br />Public Hearing is set to adopt, deny or amend the <br />Ordinance on Second. Reading. The suggested action <br />recommended simply states that Council agrees the <br />Ordinance should be published, notice of the <br />Public Hearing published and the matter actually <br />be considered at the Hearing. Council can choose <br />not to consider the Ordinance should they feel the <br />Ordinance doesn't deserve to be heard and vote <br />tonight not to publish the Ordinance. <br />Mayor Fauson called for a vote of the motion on <br />the floor.
