Unanimous. <br />BIELLA/MENKICK ANNEXATION AND <br />ZONING REQUEST Hundley clarified i;.he recommended action which is <br />to forward this annexation and zoning request to <br />the Planning Commission for their review and <br />recommendation. <br />Wanush described the applicants' request and <br />outlined the property in question. Richard Biella <br />and George and Kyung Menkick are the owners of <br />property generally located east of McCaslin in the <br />southeast and northeast quadrants of the U. S. 36 <br />Interchange. They are requesting the annexation <br />of approximately 1:17 acres currently in Boulder <br />County to the City of Louisville. 35 acres are <br />north of the Interc;hange and approximately 82 <br />acres are south of the Interchange. The <br />applicants are requesting C-B Zoning. Wanush <br />stated that since applicants' property is outside <br />the City's Comp Plan and Urban Service Area, the <br />Commission should review both the City's Comp Plan <br />and the Urban Service Area and make appropriate <br />recommendations to Council. <br />Sackett asked if the Commission recommends against <br />this request if Council will still be able to hear <br />the issue. Mayor Fauson confirmed that Council <br />still may choose toy consider the request. <br />Szymanski asked if there were any agreements with <br />nearby communities that this proposed annexation <br />would violate. <br />Hundley explained that there were no current <br />agreements with they Town of Superior. He further <br />stated that the prior Council did take action <br />indicating that Council did want to develop an <br />agreement with the Town of Superior that would <br />restrict or limit t:he City of Louisville from <br />annexing south of Highway 36 and limiting Superior <br />for annexing north of Highway 36. But this <br />agreement was never ratified by both parties. <br />Mayor Fauson moved that the Biella/Menkick <br />annexation and zoning request be referred to the <br />4 <br />
