Mayor Fauson moved that Ordinance #890 be adopted. <br />Mohr seconded. Ordinance #890 was passed <br />unanimously by Roll_ Call Vote. <br />Anderson asked to be excused during deliberations <br />on the next Agenda Item so as not to create any <br />conflicts of intere=st. <br />AMENDMENT TO POW WOW <br />AGREEMENT Mr. Herm Schempp, t=he owner of property commonly <br />known as the Pow Wow grounds, is requesting that <br />the agreement between the City and Pow Wow Inc., <br />governing the use of the property be amended by <br />adding other uses including flea markets, bicycle <br />shows and races, music and theatre concerts. <br />Wanush explained that these and any other <br />additional uses must be approved by City Council. <br />Schempp outlined th.e proposed activities at what is <br />now referred to as the Louisville Fairgrounds <br />stating that there would be approximately 6-8 <br />music and theatre concerts. He isn't sure how <br />often the flea market would take place as it may <br />"not even go." Schempp stated that the music <br />concerts would include rock, country western, jazz <br />any of which would conform to any City <br />requirements. The ]bicycle races would be contained <br />to the grounds. At some point BMX races might be <br />scheduled. All races referred to here are bicycle <br />races only, Schempp stated. <br />Staff felt that existing disturbance and nuisance <br />ordinances would cover any loud and/or late night <br />occurrences on the ;site. Wanush further stated <br />that it is part of the existing Agreement that any <br />event scheduled on the site must be submitted in <br />writing to the Direc=tor of Community Development <br />to allow for the asosessment and mitigation of any <br />possible problems. <br />Leesman stated that should additional traffic <br />control be warranted due to an event at the site, <br />the property owner would be required to pay for <br />any overtime incurred. This would be determined <br />at the time of subm=ittal to the Director of <br />Community Development. <br />Carnival moved that Council approve the additional <br />uses of flea markets, bicycle shows and races, and <br />music and theatre concerts. Scarpella seconded. <br />Unanimous. <br />Anderson rejoined tYie meeting. <br />6 <br />
