OTHER: <br />LETTER FROM R B DEVELOPMENT <br />RE: WAREMBOURG Hundley read a letter he received from Dennis <br />Drumm, Vice-president, R B Development Corp. <br />stating the withdrawal of their application to <br />annex the infiarembourg property to the City of <br />Louisville and thanked staff, Planning Commission <br />and Council for their time and effort in working <br />with them on this project. <br />PUBLIC COMMENTS Tom McAvinew, 229 Lois Drive, stated that there <br />seems to still be problems with the ditch and <br />retention pond behind his house. Hundley stated <br />that the City has not yet accepted the ditch as <br />it does not meet City specs and the developer <br />still has the responsibility to bring it up to <br />City standards. However, these items should be <br />completed as soon as possible and he will direct <br />staff to look into the problem. <br />Karen Olson, 468 W. Sycamore Ct., asked if the <br />City plays any part in monitoring the flow of <br />water in the ditches. Rautenstraus explained that <br />the ditches are not owned by the City of <br />Louisville. They are owned by the members of the <br />Ditch Companies. The City does not have the right <br />or the ability to takes steps in doing anything <br />with the ditches as the City is not the property <br />owner. The City has the obligation to take <br />reasonable steps to solve problems and as future <br />development occurs within the City, steps will be <br />taken to eliminate as many potential problems as <br />possible regarding ditches. Olson asked if <br />developers could be encouraged to put up some type <br />of barriers such as fencing, etc. to hinder <br />accessibility to the ditches. Rautenstraus <br />suggested that this would have to be up to the <br />ditch companies and possibly they could be <br />contacted by concerned people. Hundley stated <br />that he would take this suggestion under <br />advisement but could not give Olson a definitive <br />response. <br />Bob Trousil, Jr. thanked City Council, staff and <br />Fire Marshall Bill Dhieux on behalf of R. A. <br />Trousil Company for their efforts over the past <br />months in the annexation of the property this <br />evening as they will benefit and hope that the <br />City will also realize a benefit. <br />Mayor Fauson introduced Rick Schenderlein who was <br />appoint to the Parks and Recreation Task Force <br />this evening. <br />7 <br />
