" <br />Proper publication and notice of public hearing <br />were established and Mayor Fauson opened the <br />public hearing. <br />By Colorado Statues, in order for a municipality <br />to enter into a lease for a period longer than one <br />year, an ordinance must be adopted. Council <br />directed City Attorney Curt Rautenstraus to draft <br />such an ordinance. The Historical Commission and <br />City staff find the Ordinance and Lease Agreement <br />acceptable and recommend approval. <br />Mayor Fauson asked for anyone wishing to speak in <br />favor of or in opposition to the ordinance. None. <br />Szymanski stated that this is an important step in <br />preserving the City's heritage. <br />Mayor Fauson closed the public hearing and called <br />for a motion. Mohr moved that Ordinance #905 be <br />adopted. Szymanski seconded. By Roll Call <br />Vote, Ordinance #905 was passed unanimous. <br />ORDINANCE #906 - BIELLA/MENKICK ANNEXATION I - <br />PUBLIC HEARING Rautenstraus read by title only Ordinance #906, <br />"An Ordinance annexing to the City of Louisville, <br />Colorado, a parcel of approximately 33.39 acres <br />located north of U.S. Highway 36, in Section 19, <br />which is owned by Richard F. Biella." Proper <br />publication and notice of public hearing were <br />established and Mayor Fauson opened the public <br />hearing. <br />Hundley reviewed the proposed annexation and <br />commented on the following concerns expressed <br />during the Planning Commission public hearing: <br />1) The existence of an agreement between <br />Louisville/Superior to provide service; 2) The <br />observation that nothing has changed since the <br />1982 Biella Annexation vote; and 3) Concern over <br />aesthetics of the interchange. <br />Hundley stated that with regard to the issue of <br />the amendment (addendum) to the water agreement, <br />he and the City Attorney have researched this <br />issue and find that no such agreement exists. <br />Superior never signed an agreement wherein the <br />Louisville City Council included language limiting <br />either community from proving utility services to <br />the other side of the turnpike. From May 1983 to <br />August 1984, former City Administrator, Leon Wurl, <br />attempted to get Superior approval of this <br />addendum without success. <br />2 <br />
