In April 1985, Hundley met with Mayor Kupfner to
discuss an amendment and the water agreement
itself. Hundley indicated a willingness to consider
changes in the basic water agreement if desired.
The ball was left in Kupfner's court.
Hundley referenced the issue of changed conditions
since the 1982 vote. In 1984, while the City was
involved in a joint feasibility study with
Broomfield and Boulder County regarding a new
interchange at 96th Street, Broomfield abruptly
annexed land at this interchange site. In early
1985, Broomfield submitted its PUA boundaries to
DRCOG showing its intent to consider expanding its
boundaries all the way to McCaslin Blvd. in the
vicinity of the Biella/Menkick property. In late
1985, Hundley was approached by Scott Carlson who
had under contract approximately 1500 acres in
this area about possible annexation to Louisville
and proposing 8,000+ residential units. Although,
after individual consultations with Council-
members, Hundley expressed no interest, it was
clear he would pursue this proposal with either
Broomfield or Superior. At about the same time,
Hundley was approached by Broomfield City Manager
about interest in possibly sharing sales/property
tax revenues between the two Cities at both the
Louisville/Superior interchange and proposed new
96th Street Interchange -- a clear indication of
Broomfield's interest in the Louisville-Superior
Interchange. In July 1986, the Broomfield
Planning Commission recommended changing their
City's Comp Plan to incorporate Carlson's request.
By this time Louisville was considering the
Biella/Menkick annexation request.
Hundley stated that the issue is not whether this
property will be developed commercially, but
rather by whom and how.
At about this time, Carlson approached Mr. Biella
and Mr. Menkick about possible joining of develop-
ments in order to enhance Carlson's prospects for
successful annexation to Broomfield.
In early August 1986, after Louisville Planning
Commission had already recommended favorably
toward Biella/Menkick annexation, Broomfield City
Council refuses to change Comp Plan to accommodate
Carlson project. Hundley stated, "It would appear
that these two actions are tied together. Indeed,
I would argue that Louisville's willingness to
consider annexing the Biella and Menkick
properties may very well reduce the likelihood of
major residential development in this area."
3
