Wanush explained that Richard F. Biella is the <br />owner of a 33.39 acre parcel of land. It is <br />located on the north side of U.S. 36 just east of <br />the Louisville/Superior interchange on U.S. 36 and <br />the applicant is requesting annexation to the <br />City. Wanush stated that the entire <br />Biella/Menkick annexation of 114.4 acres is being <br />consider in three separate ordinances so that the <br />State Statute requirement for 1/6 contiguity can <br />be met and asked that Council relate the <br />presentation and recommendations by staff to the <br />entire Biella/Menkick annexation/zoning request. <br />Staff recommended to the Planning Commission that <br />the Biella/Menkick annexation request be approved <br />(with conditions) stating that the requirements <br />listed in the City ordinance governing annexations <br />have been met as well as the State Statutes. The <br />annexation and the requested zoning are consistent <br />with the Comprehensive Plan. Care should be taken <br />to insure that this property is developed with a <br />sensitivity to the design guidelines contained in <br />the Comp Plan. <br />At the July 8th Planning Commission public <br />hearing, Cammission recommended approval of the <br />annexation with 6 conditions: 1) all water rights <br />must be dedicated to the City; 2) all property <br />north of U.S. 36 must be developed as a single PUD; <br />3 ) all land south of U.S. 36 must be developed as <br />a single PUD; 4) at the time of subdivision, land <br />must be dedicated for bike/hike trails along <br />Coal Creek. The specific amount of land and exact <br />location shall be determined at the time of <br />subdivision; 5) Until the buried storage facility <br />is constructed on the Mesa, development on this <br />property should be reviewed by the Public Works <br />Department to insure that adequate water service <br />exists; 6 ) on the land north of U.S. 36 no <br />structure shall exceed 35' in height and no uses <br />requiring the outside storage of equipment or <br />materials shall be allowed. <br />Ken Dell, of Rocky Mountain Consultants, and <br />representative for Mr. and Mrs. Biella and Mr. and <br />Mrs. Menkick, gave a slide presentation of the <br />area, an overview of the land and its proposed <br />use. <br />George Menkick, owner of one of the parcels of <br />land being considered for annexation, stated that <br />nine developers and numerous realtors have <br />contacted he and Biella over the past four years <br />regarding possibilities of the development of this <br />property with such things as a hotel, restaurants, <br />5 <br />
