Dozier's restaurants range <br />in size from 60 to 300 capacity. <br />John Wilken, Chamber of Commerce Director, stated <br />that Louisville's business people are aware of the <br />facts presented this evening regarding the affects <br />of smoke on the non-smoker and have been working <br />on ways to regulate smoking to keep their <br />customers comfortable. Many have regulations and <br />signs posted and are disappointed that this group, <br />the proponents of this proposed ordinance, did not <br />consult with them before drawing up the ordinance. <br />Their concerns have to do mainly with items in the <br />ordinance that are not the same as Ft. Collins and <br />seem to have made this ordinance more restrictive <br />than any of the others. The business people would <br />like to make changes and sit down with the <br />proponents of the ordinance to do this. If this <br />can be accomplished, it would save the cost of a <br />special election. Wilken urged Council to set a <br />public hearing to further hear the issues. <br />Jay Carter, 809 Main St., (Pasquales Restaurant) <br />urged Council to set a public hearing to encourage <br />a broader input on the wording of the ordinance in <br />light of the financial situation of many <br />restaurants "hanging on by a thread." This is not <br />the time to act quickly on legislation that could <br />have "a devastating financial impact." Carter <br />stated that the proponents of the petition did not <br />ask for input regarding this proposed ordinance <br />and therefore asked for some time to work with <br />them. <br />Mayor Fauson asked for clarification on the <br />ability to change the wording of the Ordinance. <br />Rautenstraus stated that the Statute does not <br />provide for the Ordinance to be amended. It <br />simply says that the City Council must either <br />adopted the ordinance as presented or set an <br />election. After an ordinance is passed it can be <br />amended. <br />Sackett: "It is very difficult for a Vice <br />President of a hospital not to support a smoking <br />ordinance. I tried to do some research to find <br />what smoking can do......and it is a very signifi- <br />cant drug." "The problem that I have is that if <br />you are going to be a champion for anti-smoking <br />laws, you have to consider being a champion for <br />liberty also. What is one man's constrain is also <br />another man's liberty." "You have be careful, in <br />my opinion, that you balance the public good <br />against the loss of liberty.
