However, he will support the adoption <br />of this ordinance, hoping it will work and wait to see what happens. <br />Szymanski appreciates the letter sent by the Chamber regarding this issue, <br />but in talking to business owners, Szymanski found that many felt that <br />certain physical constraints prohibits them from complying to the letter of <br />the ordinance. It is Szymanski's opinion that it is irresponsible to pass <br />an ordinance that can not be complied with. "We know what 5g of the <br />community wants. I don't know what the other 95$ of the community wants." <br />Szymanski feels that Council should reject the ordinance and let it out for <br />a Special Election. <br />Carnival stated that he appreciates that citizens have the right to peti- <br />tion, however, this proposed ordinance has a lack of concern of what is <br />best for the City. Council's goal was to unite this City and each is <br />striving to accomplish this. Carnival is for smoking control, but does not <br />like the way it was proposed to Council and the citizens of Louisville. <br />Carnival feels that Council should not spend the money to bring it to a <br />Special Election and recommends passing it and then see what happens. <br />Scarpella echoed Council's remarks that there is a need for smoking con- <br />trol, but this is not the way to go about it. Scarpella recommends this <br />ordinance be adopted with the understanding that he does not endorse the <br />way it was initiated. <br />Mayor Fauson also resented the way it was initiated and also feels it <br />should be adopted and consider its merits as necessary. <br />Mayor Fauson closed the public hearing and called for a motion. <br />Sackett moved that Council adopt Ordinance #917 as written. Mayor Fauson <br />seconded. By Roll Call Vote, Ordinance #917 was adopted 6-1 with Szymanski <br />voting no. <br />COUNCIL ACTION - GROWTH RELATED INITIATIVE <br />Hundley explained that on September 19th, the City Clerk, Pam Ferris, <br />received 12 copies of a petition for initiative with 311 signatures con- <br />cerning "An Ordinance enacting a new article to the Louisville Municipal <br />Code to require policies that relate class size and water supply to issuing <br />residential building permits, setting a residential growth rate, limiting <br />residential annexations, maintaining a buffer along U.S. 36, limiting <br />annexations south of U. S. 36, encouraging the development of a super- <br />market, and requiring an election to change agricultural zoning." The <br />electors petition Council to pass said ordinance or have the proposed <br />ordinance be submitted to a vote of the registered electors of the City of <br />Louisville for adoption or rejection. <br />Presenters Comments: <br />Erik Judson, 280 W.
