Davidson called for Council comments and questions. <br /> <br />Susan Griffiths, City Attorney, stated that she is and has been <br />reviewing the history of the property, so she may understand the <br />rights and obligations the developer and the City have. She <br />explained that this research had not been completed. She asked <br />that when they get their review done, they have the opportunity to <br />review the information with Mr. Hoyt. <br /> <br />Hoyt stated that he felt that they have a vested right in the <br />project, based on some of the specific agreements. He had asked <br />Curt Rautenstraus, the City Attorney at the time, to contact <br />Griffiths to shed some light on the subject. <br /> <br />Griffiths: <br /> <br />In your response on the density, I <br />understood you to say you felt you <br />had a vested right in the <br />development. Does that include any <br />particular density on this project <br />or are you not prepared to respond <br />to that tonight? <br /> <br />Hoyt felt that they are entitled to the 162 units that is on the <br />current Master Plan. <br /> <br />Hornbostel wanted to know the price range of this housing. <br /> <br />Hoyt: We were contemplating in <br /> $120,000 - $150,000 range. <br /> <br />the <br /> <br />Hornbostel wondered if the phasing could be adjusted. She asked <br />Hoyt to let Council know how the grading is going to work and where <br />the 33' height comes from. <br /> <br />Hoyt agreed. <br /> <br />Hornbostel felt the number of buildings was overwhelming and that <br />there could be more landscaping. <br /> <br />Lathrop wanted some projects to compare the density to. He <br />explained that you can't "scab" a 4' walk onto a 4' walk, from his <br />experience in the concrete business. <br /> <br />Mayer felt that there was a lack of interior open space or an open <br />area for the residents to congregate. He'liked the club house. He <br />felt the City's staff and McStain needed to figure out what happens <br />at the end of West Pinyon Way. He thought there should be "No <br />Parking" signs on upper Pine Street. He wanted to eventually see <br />an under-street crossing on Via Appia, where the major exit is. He <br />wanted 2" - 2 1/2" diameter trees planted on the site. He felt the <br />setbacks might be looked at. <br /> <br />14 <br /> <br /> <br />
