Louisville City Council Meeting <br />April 15, 2OO3 <br />Page 4 of 14 <br /> <br />Davidson called for Staff presentation. <br /> <br />Planning Director Paul Wood reported the applicant and owner, The Colorado Tech Land <br />Company, LLC, is requesting a rezoning of a portion of CB parcel located at the <br />northwest comer of Dillon Road and South 104th Street. The purpose of the rezoning is <br />to reduce the area of the CB parcel at 10.7 acres to correspond to the proposed area of Lot <br />12, which would be 7.53 acres. The rezoning is limited to the north and west perimeter <br />of Parcel D, or proposed Lot 12. The Planning Commission determined the requested <br />rezoning would serve a beneficial purpose in avoiding a situation where lots contiguous <br />to the proposed Lot 12 would have a dual zone designation and approved the request <br />without conditions. <br /> <br />Davidson opened the public hearing and asked if anyone in the audience wished to speak <br />in favor or against Ordinance No. 1419, Series 2003. There were no comments. <br /> <br />MOTION: Brown moved for Council approval of Ordinance No. 1419, Series 2003, <br />seconded by Sisk. Roll call vote was taken. The motion passed by a vote of 7-0. <br /> <br />PUBLIC HEARING ON ZONING ANNEXATION OF THE RAY PROPERTY - <br /> public hearing (advertised .Daily Camera 3/8/03) <br /> <br />RESOLUTION NO. 8, SERIES 2003 - A RESOLUTION CONCERNING A <br />PETITION FOR THE ANNEXATION OF PROPERTY TO THE CITY OF <br />LOUISVILLE, COLORADO, KNOWN AS THE RAY ANNEXATION, AND <br />FINDING THE AREA PROPOSED TO BE ANNEXED ELIGIBLE FOR <br />ANNEXATION <br /> <br />City Attorney Sam Light noted under state statute, the City must hold a public hearing on <br />the merits of the proposal and receive testimony on the annexation and zoning. <br /> <br />Davidson called for Staff presentation. <br /> <br />Planning Director Paul Wood reviewed Resolution No. 8, Series 2003, which establishes <br />the parcel is eligible for annexation and meets all the requirements. The subject property <br />is a .56-acre unincorporated parcel owned by James S. Ray and Christina Dozauer-Ray. <br />He explained the Ray's approached the County for a building permit and were referred to <br />the City for the purchase of a sewer tap. He stressed this is a small annexation with a <br />single-family residence. Upon Council consideration of the annexation, Ordinance No. <br />1416, proposes the SF-MD zoning of property. As a condition of the annexation, the <br />applicant would convey to the City a conservation easement, which is a covenant <br />restricting the use of the parcel to one single-family residence. <br /> <br />Davidson opened the public heating and asked if anyone in the audienCe wished to speak <br />for or against annexation.
