Brown, riot Lockett Brown as reported in <br />the minutes.) <br />PUBLIC COMMENTS None. <br />ARBOR DAY PROCLAMATION Mayor Meier read th~.e proclamation in its entirety <br />declaring April 1?'~th - April 20th as Arbor Week <br />and April 20th as Arbor Day. <br />RESOLUTION #6 - <br />OPPOSITION TO H.B. 1360 <br />CREATION OF VESTED <br />RIGHTS Rautenstraus read Resolution #6, "A Resolution <br />Opposing the Adoption of House Bill 1360 <br />Concerning the Creation of Vested Property Rights" <br />in its entirety. Mayor Meier moved that <br />Resolution #6 be adopted and Luce seconded. <br />Luce spoke in favor of the resolution commenting <br />that our Representative, Les Fowler, is a crucial <br />contact and that the Council should formally <br />present Rep. Fowler with this resolution. "This <br />bill would impose upon municipalities the <br />liability in terms of what the City would be <br />responsible for should its citizens decide to <br />initiate a zoning issue. It would compromise the <br />right of initiative." <br />Leary stated that it not only concerned zoning, it <br />also states that "any land use regulation" would <br />forever be precluded from alteration any land use <br />regulation applicable to the property which <br />includes subdivision regulation, site design, <br />landscaping, slope, soil, sign, drainage <br />requirements, and set-back and height <br />restrictions." If this bill were to pass, any <br />change that the City made from that point on would <br />not apply to any property that was zoned prior to <br />the passing of this bill creating totally <br />different standards applying to different people <br />over a course of time. <br />2 <br />
