Leary offered an amendment to the resolution <br />adding "interfere with citizens' rights to <br />initiative" thereby, having the first line read: <br />"Whereas, the Colorado State Senate is considering <br />the adoption of House Bill 1360 which would create <br />a new doctrine of vested property rights and <br />interfere with citizens' rights to initiative." <br />The motion to amend the resolution was seconded by <br />Luce and approved unanimously. <br />The motion to adopt Resolution #6 as amended was <br />approved unanimously. <br />Leary asked that Mayor Meier send the letter to <br />Senator Fowler urging him to vote against House <br />Bill 1360 with this Resolution #6 attached. <br />RESOLUTION #7 - <br />LOUISVIEW ASSOCIATES Rautenstraus read Resolution #7, "A Resolution <br />Authorizing the Condemnation of Right-of-Way for <br />McCaslin Boulevard" in its entirety. Mayor Meier <br />moved that Resolution #7 be approved. Cussen <br />seconded. <br />Morris asked if there were any other way to obtain <br />immediate possession for the McCaslin right-of-way <br />without this particular condemnation. <br />Hundley related that moving this to any other area <br />would be very costly. To use another parcel would <br />leave a significantly larger section of unusable <br />land. Proper berming and landscaping will create a <br />good separation. <br />Hioco told Council that tree planting in this berm <br />was not scheduled until the completion of South <br />Boulder Road in 1990. <br />The motion to approve Resolution #7 was passed <br />unanimously. <br />UPDATE ON PHASE II <br />WATER TREATMENT PLANT Letters from Rocky Mountain Consultants were <br />included in Council's packets regarding the <br />progress of the Water Treatment Plant Phase II <br />work and disruption of water service on the <br />evening of March 22. Hundley related to Council <br />that the upcoming potential service disruptions <br />would be published in both the Louisville Times <br />and the Boulder Dai:1y Camera and letters would be <br />distributed to presidents affected by the <br />disruptions. <br />3 <br />
