Leary offered an amendment to the resolution adding "interfere with citizens' rights to initiative" thereby, having the first line read: "Whereas, the Colorado State Senate is considering the adoption of House Bill 1360 which would create a new doctrine of vested property rights and interfere with citizens' rights to initiative." The motion to amend the resolution was seconded by Luce and approved unanimously. The motion to adopt Resolution #6 as amended was approved unanimously. Leary asked that Mayor Meier send the letter to Senator Fowler urging him to vote against House Bill 1360 with this Resolution #6 attached. RESOLUTION #7 - LOUISVIEW ASSOCIATES Rautenstraus read Resolution #7, "A Resolution Authorizing the Condemnation of Right-of-Way for McCaslin Boulevard" in its entirety. Mayor Meier moved that Resolution #7 be approved. Cussen seconded. Morris asked if there were any other way to obtain immediate possession for the McCaslin right-of-way without this particular condemnation. Hundley related that moving this to any other area would be very costly. To use another parcel would leave a significantly larger section of unusable land. Proper berming and landscaping will create a good separation. Hioco told Council that tree planting in this berm was not scheduled until the completion of South Boulder Road in 1990. The motion to approve Resolution #7 was passed unanimously. UPDATE ON PHASE II WATER TREATMENT PLANT Letters from Rocky Mountain Consultants were included in Council's packets regarding the progress of the Water Treatment Plant Phase II work and disruption of water service on the evening of March 22. Hundley related to Council that the upcoming potential service disruptions would be published in both the Louisville Times and the Boulder Dai:1y Camera and letters would be distributed to presidents affected by the disruptions. 3
