"The .implication that this ordinance <br />is gutting the citizen's initiative petition I <br />find to be a reaction and I don't think its a <br />statement or an opinion that is based on a careful <br />analysis of what this ordinance purports to do. I <br />would urge Council to vote in favor of the motion <br />on the floor." The ordinance was adopted <br />unanimously by ro 7'_ 1 ca 11. <br />ORDINANCE #858 - <br />VEHICLE PARKING POLICY Mayor Meier opened the Public Hearing on Ordinance <br />#858. Rautenstraus read by title only Ordinance <br />#858, "An Ordinance regarding the ticketing and <br />towing of vehicles parked on private property." <br />The ordinance was properly published in its <br />entirety May 8, 15-85, and notice of Public Hearing <br />was published May 15 and 22, 1985. <br />Mayor Meier asked for public comments in favor or <br />in opposition to Ordinance #858. None. <br />Mayor Meier asked for Council questions and <br />comments. Morri;~ asked what had changed in the <br />wording of the ordinance since the initial <br />presentation to Council. Rautenstraus related <br />that some wording had been deleted regarding <br />"stopping or parking". The word "stopping" had <br />been deleted. Other ordinances from other <br />municipalities ]zad been reviewed and it was <br />determined that the wording of this ordinance was <br />the standard mode. of operation in setting up an <br />ordinance regarding this issue. Also reviewed <br />were remedies that an owner of a vehicle might <br />have if the ordinance was abused and determined <br />that there was po~tentia 1 for an owner of a towed <br />vehicle to seek to protect themselves from <br />capricious acts. <br />Morris' concerns were with regard to the <br />coordination of towing fees so that there would be <br />a set charge to protect a person from being <br />charged more than another. Rautenstraus said that <br />the charges were governed by the market and that <br />there were not many towing companies in the <br />immediate area. It would be difficult to <br />accomplish anything without entering into the <br />position of regulating rates. <br />Morris related that this had been a major issue in <br />Boulder and in fact two vehicles towed from the <br />same place could conceivably be charged two <br />different rates depending on which towing company <br />6 <br />
