City to notify Homart in writing as to what the <br />proposed alternatives are. They then can exercise <br />their option of taking out the remainder of their <br />capacity. The Citty will negotiate with Homart for <br />the most favorable agreement. <br />Hundley explainE~d that because of provisions in <br />the agreement with Homart the City can not expect <br />from Homart any payments for sewer taps from <br />commercial or residential until 1990-1991. <br />However, if they take out the additional capacity <br />provided for in the agreement, Homart would be <br />buying out their option and would not have any <br />further obligation to the City of Louisville. <br />Leary expressed h:is opinion that this provision in <br />the Homart agreement was unfortunate and although <br />this Council can't be blamed, the City negotiated <br />a bad agreement in that Homart can buy capacity <br />cheaper than anyone else and thereby pushing some <br />of that cost onto existing residents. <br />Mayor Meier moved that staff proceed with the <br />design of the 2.1 mgd Wastewater Treatment Plant <br />Expansion and notify Homart requesting a decision <br />from them as to what alternative they will pursue. <br />Johnson seconded. Unanimous. <br />CITY SHOPS Luce asked that this item be put under Regular <br />Business and asked for clarification of the water <br />and sewer services to the shop site. Phare <br />explained that the installation of these two items <br />would be done in-house and therefore this item was <br />omitted f rom tY'ie contract. Also, the phone <br />estimate of $1,000 may not be completely adequate <br />initially, however, it will provide basic <br />communications. <br />Hundley responded to Council's concerns with <br />regard to archii:ectural fees specifically the <br />substantially higher bids than estimated. The <br />architectura 1 f ees contract ca 1 1 s for an 8 ~ top <br />set of time and nnaterials. If there should be a <br />variation to this fee, staff will bring it back to <br />Council. <br />COUNCIL WORK SESSION Hundley recommended that a Council work session <br />would be advisab]_e for the next week as there are <br />a number of issiues related to the budget that <br />staff would like to discuss. The work session was <br />scheduled for Auqust 15th at 7:30 p.m. <br />COUNCIL COMMENTS In reply to an :invitation by the Boulder City <br />Council for dinner, Morris stated that she would <br />be arriving late.
