This subdivision <br />would allow 8 residential units to be constructed. <br />As presented by the applicant, these units would <br />be for senior citizens. Zoning in the area is RM <br />and the 8 units could be built by right. The <br />maximum lot coverage is 35~. <br />Ray Sears, Developer, explained that the 8 <br />individual units would be in the form of <br />condominiums with a condominium association to <br />determine the definition of a "senior". There <br />will be 2 parking spaces and 1 garage per unit. <br />The irrigation ditch will be re-routed along the <br />property line and will be landscaped. <br />Sears asked that if the stipulation (housing for <br />seniors only) presents a hinderence to gaining <br />financing for thin project, Council would relax <br />their stance on this point. <br />Morris stated that she is "not willing to make it <br />so easy to back out of the provision for seniors. <br />If it should becomE~ a legal issue, I am certainly <br />willing to take a look at that. I would like to <br />go along with that requirement that it be geared <br />for seniors and that be part of the subdivision <br />agreement. This ]gas been proposed as a senior <br />housing ... and I would like it to be included in <br />the agreement as such." <br />Rautenstraus stated that it could be written into <br />the agreement that; Council would be required to <br />listen and act rE~asonably with respect to the <br />request. This was satisfactory to Morris and <br />Sears. <br />Mayor Meier moved that Resolution #15, Series <br />1985, be adopted as was amended by the Planning <br />Commission and City Council. Fauson seconded. <br />Unanimous. <br />RESOLUTION #16 - <br />SUNDANCE II REPEAT Rautenstraus read :Resolution #16 in its entirety, <br />"A Resolution approving a final subdivision replat <br />for Sundance II Subdivision." <br />As presented by Wan.ush, this proposal called for a <br />replat of 3.5 acres at Pine Street and South Polk <br />Avenue with a different street system containing <br />only one cul de sac with no islands. The Planning <br />Commission approved the replat with the following <br />conditions: 1) All ROW's, including the <br />3 <br />
