Sisk stated that Marshall Lake is the subject of significant <br />litigation later this year. It is his understanding that the City <br />of Lafayette is one of the parties opposing Louisville's use of <br />Marshall Lake. <br /> <br />Phare: <br /> <br />They're objectors in the case to <br />make sure their water rights are not <br />impacted. <br /> <br />Sisk wondered if there would be any guarantee, if Louisville buys <br />the shares of stock from Lafayette, that they won't object. <br /> <br />Phare: <br /> <br />No. The decision to go forward with <br />the option is a separate decision <br />that can be made at most anytime <br />within the terms of the agreement by <br />counsel. <br /> <br />Howard wondered if legally the City would be able to have as a <br />condition that Lafayette would not intervene in those shares that <br />they convey to Louisville. <br /> <br />Lathrop was concerned with the Northern Colorado pipeline, how it <br />would affect the value of future shares of Marshall Lake that would <br />go on the market. <br /> <br />Mayer moved that Council approve the Louisville/Lafayette Water <br />Agreement with Lafayette's language for the Marshall Lake Shares. <br /> <br />Davidson offered a friendly amendment that the City would approve <br />it with or without the Marshall Lake shares. <br /> <br />Mayer accepted that. Lathrop seconded. <br />Motion passed by a 7 - 0 vote. <br /> <br />Roll call was taken. <br /> <br />APPROVAL OF BID AWARD - LANDSCAPE MAINTENANCE CONTRACT <br /> <br />Keany was concerned that the bids received were so <br />$36,691.72, $59,360.00, and $218,318.00. He wondered <br />bidders understood fully what they were bidding on. <br /> <br />varied: <br />if the <br /> <br />Steve Baysinger, Parks & Recreation Director, couldn't explain the <br />differentiation, but the low bidder, L & M Enterprises, Inc., bid <br />the job last year, so they are very familiar with the job. He felt <br />comfortable with them and satisfied with the job they had done. <br /> <br />Howard moved that Council award the bid award and authorize the <br />Mayor to sign the landscape maintenance contract with L & M <br />Enterprises, Inc. for $36,691.72. Seconded by Mayer. Roll call <br />was taken. Motion passed by a 7 - 0 vote. <br /> <br />13 <br /> <br /> <br />
