extent of public improvements are minimal and are not covered under <br />an existing subdivision agreement. The Planning Commission held a <br />public hearing on February 22, 1994 and approved this 7 - 0 without <br />conditions. The development agreement has been approved in form by <br />the City Attorney and will come back before Council as a <br />Discussion/Motion later in this meeting. <br /> <br />Davidson opened the public hearing calling for anyone in the <br />audience wishing to speak on Ordinance No. 1146. <br /> <br />NONE <br /> <br />Davidson closed the public hearing and called for Council comments, <br />question, or motions. <br /> <br />Howard moved that Council adopt Ordinance No. 1146, Series 1994, on <br />second and final reading. Seconded by Keany. Roll call was taken. <br />Motion passed by a 7 - 0 vote. <br /> <br />CABLE TELEVISION RATE REGULATIONS PUBLIC HEARING - <br />CONTINUANCE TO MAY 3, 1994 REGULAR CITY COUNCIL MEETING <br /> <br />REQUEST <br /> <br />Chris Miller, Assistant to the City Administrator, requested a <br />continuance of this item until May 3, 1994, because to date the FCC <br />has not issued any regulations on the new basic cable rates in <br />relation to the February 22, 1994, FCC ruling ordering a 7% rate <br />reduction. The City has until May 15, 1994, to complete its review <br />of the rates submitted by Scripps Howard. Scripps Howard cannot <br />raise any of its rates that the City has a regulatory authority <br />over, nor can they raise the expanded or premium rates, as there is <br />an FCC imposed rate freeze until May 15, 1994. <br /> <br />Davidson opened the public hearing. <br /> <br />Sisk moved that Council continue the public hearing until May 3, <br />1994. Seconded by Mayer. All in favor. <br /> <br />AUTHORIZE CITY ATTORNEY TO WORK WITH APPROPRIATE PARTIES TO PREPARE <br />BALLOT ISSUE FOR NOVEMBER ELECTION TO AUTHORIZE BONDING FOR <br />ACQUISITION OF OPEN SPACE <br /> <br />Davidson wanted this put on the Agenda because: <br /> <br />1.) <br /> <br />3.) <br /> <br />Open space is rapidly disappearing commodity within the <br />City, especially when it comes to enclaves. <br />Land prices are increasing in this area at a much more <br />rapid rate than the interest rate on the bonds, so it <br />would be cheaper to acquire land to bonding, rather than <br />save the money and buy the land. <br />It allows Louisville to acquire larger sections of land <br />and have more choice in what is acquired and when it is <br />acquired. <br /> <br /> <br />
