2.)

They had a problem with paragraphs 8.11, Dyer Road Right-
of-Way and 8.12, Parcel S-3. The problem was in signing
a document where they agree to do something, as in 8.11.
They will endeavor to do that, but at this time, if this
Agreement is signed, he would advise 1007 Corporation not
to sign it until they have an agreement with Homart
Development Company. Similarly, that would satisfy the
obligations that the subdivider would have under 8.12.

Annette Brand, City Administrator, commented that the Council is
being asked to handle things that should be handled at the staff
level. The only thing Council needs to work on at this meeting is
to approve or disapprove Section 8 of the Subdivision Agreement.
As far as recoveries, they are worked out in the Public Works and
Planning Departments.

Davidson called for Council questions.

Sisk wondered if 1007 Corporation was still the owner of this
property? Has there been a conveyance?

Judd:

No. The 1007 Corporation owns the
property and it has the right to
acquire the Stelmack property, the
10 acres to the south of it.

Mayer moved that Council adopt Chapter 8 of the Colony Square
Subdivision Agreement with the changes as submitted by staff.
Seconded by Howard. Roll call was taken. Motion passed by a 7 -
0 vote.

DISCUSSION/DIRECTION - REQUEST TO LIFT "WEEKENDER
RESTRICTIONS ON MAY 7 & 8 AND ON MAY 14 & 15, 1994

SIGN"

Martha Bredehoeft, Boulder County Chapter of the Homebuilder's
Association of Metropolitan Denver, asked Council to lift the
"Weekender Sign" restrictions on May 7 & 8 and May 14 & 15, 1994,
for the bi-annual Tour of Homes. A Wonderland home on West Pine
Street will be featured, along with three homes in Lafayette.
Signs will be placed no earlier than 6:00 p.m. on Friday, May 7,
and Friday, May 14. They will make sure the signs are removed by
8:00 p.m. on Sunday each weekend of the tour.

Howard moved that Council approve the lifting of the Weekender Sign
restrictions. Seconded by Mayer. All in favor except Davidson.

ICE RINK PUD

Phil Paolilli, 1416 Garfield Court, Louisville, Colorado, member of
the Board of Directors for the Boulder Valley Hockey Association.
They have been helping the Boulder Valley Hockey Foundation bring
an ice arena to the City.

13
